POLISH VERSION OF APEL:
Appeal on the threat of democracy and human rights in Poland
Ladies and gentlemen,
Three months ago, there were parliamentary elections in Poland, in which the coalition of parties proclaimed their desire to improve democratic standards and reconstruct the supposedly threatened regulation of law took power. In the meantime, not only were the democratic institutions of the state attacked in a fewer weeks and many fundamental principles of the Polish Constitution were broken, but freedom of speech was radically threatened. The first political prisoners besides appeared. The debate begins to be replaced by organization and increasingly physical violence. Politicians, justice, and even private business are intimidated.
Poland, after years of communism, was rebuilding its democratic institutions with large difficulty dropping the yoke of the totalitarian past imposed on us by the occupiers from Moscow. Despite large economical progress, changes in any areas, especially the judiciary, have gone slow and without serious mistakes. To this day, in the courts, despite the old age, there are those liable for repression of the martial law of the communist regime.
The criticism of the changes was connected by parties who late took power in Poland. alternatively of improving democratic standards, we have an attack on the democratic institutions of the state and a dangerous threat to freedom of speech.
The first decision of the fresh government was a forceful takeover of public media. In accordance with Polish law, the board of directors on these media should be held by institutions independent of the government, which have Polish mandates. Meanwhile, government-designated individuals disabled the signal of the main news television, and with the aid of hired employees of private safety companies, legal media boards were forcibly removed. They were not allowed to return to work even after the decisions of the courts declaring the government to be against the law.
Hundreds of journalists can't take the job, and tens of them have already been fired. The base of the power camp besides organizes private media attacks that critically look at its actions. There is simply a mechanics of slander and intimidation known from authoritarian regimes.
Early in the year, police entered the presidential palace arresting without the President's cognition and consent of 2 MPs persecuted for fighting corruption. Both Members have taken hunger and their lives are at risk.
Arrests would not have been possible if the power had not rejected the decision of the Polish Constitutional Court, which had previously ruled that action against Members was illegal. A akin decision was made by the ultimate Court Chamber appointed by the Act, and both Members were pardoned by the President.
Unfortunately, no of these key institutions of the state were respected for Polish democracy. The Marshal of the Sejm, representing the majority of the government, ordered the judgement of the case not designated for this Chamber of the ultimate Court, the only Chamber in which inactive the persons liable for repression of the martial law of 1981 sit.
A large proportion of prosecutors and judges refuse to submit to the pressures of fresh power and there are further acts of lawlessness. It was completely incompatible with the law to deprive the prosecution of its leadership. With the hands of the minister of justice, it is attempted to block the actions of independent prosecutors seeking to explain the charges against the fresh power.
There are serious signals about threatening private business, too, which could lead to initiatives that are unfriendly to the government. The independency of the Central Bank is threatened and the decisions of the Polish Constitutional Court are completely ignored.
For many people in Poland and in the planet it is simply a shock that politicians who went to power with the slogans of improving Polish democracy and restoring the regulation of law introduce standards akin to those we see present in Belarus or Russia.
Poland turns in a dangerous direction, destroying the most basic civilian rights, stopping democratic institutions. This cannot be accepted in the name of any political plan. specified action must be opposed to global public opinion.
