The Sejm voted on Tuesday to waive the immunity of erstwhile national defence minister Antoni Macierewicz. The decision opens the way to bring him to justice.

An application for the waiver of immunity was sent to the Sejm in early July. The prosecution plans to charge the erstwhile defence minister with disclosing classified information at the time he directed the work of the Smolensk subcommittee.

Antoni Macierewicz loses immunity

Investigators say that PiS policies made public data from papers covered by the "closely secret" clause, as well as the results of investigation into the causes of the Smolensk disaster of April 10, 2010. He's facing up to 5 years in prison.

On Monday, the Rules of Procedure Committee for Members and Immunities of the Sejm at a secret sitting examined this request from the prosecution. On Tuesday, the Sejm decided to waive his immunity as a PiS MP.

240 Members voted for the waiver of immunity. It was 190. 9 Members abstained.

Let us remind that the alleged Smolensk Subcommittee is an organ established in 2016 by Antoni Macierewicz, then Minister of National Defence, in order to re-examine the causes of the Smolensk disaster of April 10, 2010.

In July of that year, the then lawyer General Adam Bodnar applied to the talker of the Sejm Simon Holowna for approval to bring Antoni Macierewicz to criminal responsibility.

"In view of the protection of associate Antoni Macierewicz, parliamentary immunity, the consent of the Polish Sejm to a criminal charge for the actions prosecuted by the public prosecution determines the anticipation of charging him with the offence described in the application and performing another procedural acts involving him" - the investigators stressed. Here we wrote more about it.
