Not 20 1000 zlotys, but 2 1000 zlotys in damages will be awarded to 3 Polish and German journalists from soldiers of the Territorial Defence Army. This was the decision of the Court of Appeal in Białystok, which ruled on detention, which, according to the Court of First Instance, was legal but not legitimate. The case began in November 2021. This was the first year of the hybrid war launched by Russia and Belarus against Poland. Only a fewer days after the attack of the border crossing in Kuźnica by illegal migrants. In the village of Guszczewina in the territory of Hajnów, soldiers detained 3 journalists who were just under the region of the state of emergency. This was a border area where no outsiders could enter. The soldiers stopped and identified journalists, though they did not know who they were at once. They had assurance only after they showed their journalism credentials. The soldiers besides rapidly summoned the Border Guard, which had completely different powers than the soldiers in those circumstances. As it turned out, the soldiers had journalists empty their pockets and kept them in 1 place until the Border defender arrived. And that's what the Court of First Instance found to be unfounded, more specifically, that journalists were taken distant from their homes.
