Significant changes in taxation controls by taxation offices are imminent. The checks to date have been carried out selectively, frequently including the analysis of taxpayers' bank accounts. However, since July 2024, a crucial transformation has been envisaged in this area, which raises concerns among both entrepreneurs and honest taxpayers.
These envisaged changes aim to increase the effectiveness and efficiency of taxation controls and to increase transparency in the taxation collection process. The controls carried out so far on the basis of the selection of certain taxpayers will most likely be replaced by a more systematic approach. This is intended to aid taxation authorities analyse and verify taxation data and to combat taxation fraud.
Concerns about these changes are widespread as they affect the full spectrum of taxpayers, both honest and possibly unfair. Many taxpayers fear breaching their privacy and excessive interference in their individual finances. Therefore, there is simply a request for a thorough knowing and preparation of these envisaged changes.
Massive changes since 2024
Changes in government bring many crucial news in taxation control and invoices. 1 of the key transformations is the planned introduction of the National e-Faktur strategy (KSeF) from 1 July 2024. This strategy aims to improve both the generation and retention of invoices and their electronic transmission. This control to electronic invoices opens up fresh opportunities for taxation authorities, enabling them to analyse and verify taxation data more effectively.
It should be noted that, while KSeF has the possible to make life easier for entrepreneurs by improving the invoicing process, it besides introduces restrictive sanctions for non-compliance. The punishment for issuing an invoice outside the strategy can be charged up to 100% of the taxation value or 18.7% of the full value of the invoice.
