Rule of Law Observer: Ordo Iuris papers government infringement

Ordo Iuris Institute launched the portal Law Enforcement Observer. This is simply a website dedicated to the papers of public authorities' violations of the regulation of law from 13 December 2023. The Institute informs about all the most crucial actions of the current government which undermine the constitutional principles and rights and freedoms of citizens, on which the constitutional legal order of the Republic of Poland is based.
The website will be updated on an ongoing basis. Ordo Iuris hopes that these actions will call on the current government to remember and halt further violations, while the public will mobilise to actively uphold constitutional order. The Institute requests the authorities to study the alleged infringements of the regulation of law utilizing the form on the portal https://observator-laws.pl/

Full content of the declaration signed on 16 June 2024 by the initiators of the project – Instytut Ordo Iuris, Association of Lawyers for Poland, National Association of Judges of Poland, Association of Prosecutors Ad Vocem, Warsaw Seminar of Axiology Administration and Foundation Institute of Justice:
Recalling the words of the judges' rota and the vows made by representatives of the legal professions, we declare the faithful service of the Republic of Poland, work to strengthen the legal order of the Homeland and mechanisms for protecting civilian rights and freedoms. We want to renew our trust in the judiciary, reconstruct citizens' access to an efficient and impartial justice system, and our professional function in its exercise, with peculiar emphasis on judicial independence, the principles of professional ethics, dignity and integrity in enforcing the rights of the Republic of Poland established for the protection of social governance, rights and civilian liberties.
We all share the concern for Homeland, which, in accordance with Article 1 of the Polish Constitution, is the common good of all citizens.
Seeing cases of manifest disregard for the principles on which the regulation of law is based, we remind you that, under the current Constitution, it is simply a condition of the regulation of law to respect the hierarchy of legal acts and to act only within the limits and on the basis of the law by all the authorities of the state.
In the context of the deepening constitutional crisis, which includes the questioning by the executive and legislative authorities of the principles of the independency of courts and the independency of judges, as well as the principles of legalism and the regulation of law, which form the basis for the functioning of a democratic regulation of law, we argue the differentiation of the position of judges, the unlawful takeover of the public media, the prosecutors with the National Public Prosecutor's Office at the head, the administration of courts with appeal courts, as well as our concern with respect to government-promoted political projects to rebuild and restrict the democratic legitimacy of the National Judicial Council, the changes in the ultimate Court's system, and the announced questioning of the jurisprudence of the Constitutional Tribunal, which, in the light of the fundamental law, enjoys the ‘final’.
The organisations represented by us undertake to cooperate closely for the restoration of a unchangeable justice strategy and respect for the Constitution of the Republic of Poland, the strategy of sources of law and legal principles constituting a legacy of European and Christian tradition.
The cooperation undertaken by the organisations we represent will take into account the different nature of the professions carried out in the implementation of the common nonsubjective of halting the ruin of the strategy of law, which is visible in all area of state activity.
As representatives of the legal professions, including judges, prosecutors, lawyers, legal advisers, bailiffs, notaries, representatives of the planet of science, we declare to argue all acts of lawlessness, condemning the perpetrators and their actions, and we besides undertake to take all measures to settle those who, with the slogan, reconstruct the regulation of law, commit to violating the Constitution of Poland and the legal practice applicable to the European cultural circle. Thanks to our cooperation, not only will all cases of violation of the Constitution of Poland be written down, but the consequences for the perpetrators of the systemic crisis experienced by us will be drawn up in the future.
We declare that we will do our best to settle the acts of lawlessness committed by persons who held various functions and offices after 1989, regardless of where they are. We owe it to those who gave their lives in the fight for independent Poland.
Seeing professional opposition, and frequently the distaste and mischief with which the actions of the state authorities are received in our environments, we address these judges, lawyers, prosecutors, legal counsellors and bailiffs and notaries who want to service the regulation of Law, in which equality before the law, justice and human dignity find appropriate legal protection. There is simply a place for you among us.
It is time to express firm support for nonsubjective constitutional order. It is time for a categorical rejection of legal relativism included in the Prime Minister's memorable words about "law, as we realize it."
We are aware that the answer will be a decisive attack of interest groups and political cateries and hostile actions of the state apparatus, but we are convinced that the time has come for lawyers of the Republic of Poland to give evidence to the best ideals and principles upon which the political and legal building of our Homeland was erected. Behind the Preamble of the Constitution of the Republic of Poland, referring to the best traditions of the First and Second Republic, the commitment to convey to future generations all that is valuable from over a 1000 years of achievements.
