70 million PLN for "envelope election". Here are the scenes of this affair

The Baltic paper added to the content of the order of the territory Court in Warsaw concerning a complaint against the order of the territory Prosecutor's Office in Warsaw to refuse to initiate an investigation on the alleged "envelope elections". The prosecution's charge is very serious.

The territory Attorney's Office in Warsaw conducted proceedings as a consequence of many reports of suspected crimes committed by public officers in connection with the organizational process of election of the president of the Republic of Poland in the procedure of correspondence voting, ordered on 10 May 2020.

The territory Attorney's Office in Warsaw refused to investigate:

  • Overshoots of powers on 16 April 2020 in Warsaw by the Prime Minister, consisting of the advice of Poczta Polska SA to undertake actions, consisting in taking and implementing the essential actions to prepare the election of the president of Poland in correspondence.
  • Overshoots of powers between 16 April 2020 and 8 May 2020 in Warsaw by the Minister of State Activities, consisting in supervising the activities of the Polish Securities Printing Works SA in the form of printing ballot cards in the presidential elections ordered on 10 May 2020 and the actions of the Polish Post Office in order to take and implement the essential steps to prepare for the election of the president of Poland in 2020.
  • Excess of powers by public officers – Minister of Digitization and officials of the Ministry of Digitization on 22 April 2020 in Warsaw, consisting in making available to the commercial entity, i.e. Post Polski SA. delicate data collected in the PESEL registry in connection with the ordered elections on 10 May 2020.
  • Processing, on 23 April 2020, of individual data of voters by an entity not authorised to process them, by sending to local government authorities, i.e. mayors, city presidents, via electronic message a request for the transfer of individual data in the e-mails conducted by the abovementioned e-mails of voters, in connection with the ordered elections of the president of Poland on 10 May 2020.
  • Abuse of powers, at an unestablished time, not earlier than in April and no later than 10 May 2020 in Warsaw, granted to members of the Management Board of PWPW obliged to deal with the assets of this company, by taking actions measured to organise the presidential elections in the form of correspondences ordered for 10 May 2020, consisting of printing election packages for starving in the above-mentioned elections, resulting in the failure of property in large sizes of around PLN 70.000.000, i.e. on the operation of Articles 296&1 and 3 kk.
  • Abuse of powers, indefinitely, not earlier than April and no later than 10 May 2020 in Warsaw, granted to members of the Management Board of the Polish Post Office to deal with the property matters of this company, by taking measures to organise the presidential elections in the form of correspondence scheduled for 10 May 2020, including the completion of electoral packages, the transportation of electoral urns and bags in which votes were to be carried, the action to issue large size property harm in the amount of about PLN 70,000,000, i.e. the act of art. 296& 1 and 3 kk.
  • Unlawful threat on 24 April 2020 in Warsaw by the Minister of State Acts of influence on the authoritative activities of local government bodies during the broadcast in the program Tłit Wp. published on the net platform Virtual Poland, by threatening criminal liability in the event that these authorities do not supply individual data contained in the lists of voters of Poczcie Polska SA, i.e. for action with Art. 224&1 kk.
  • Inciting authorities of local government, i.e. mayors, mayors, city presidents in a period not fixed, not earlier than 16 April 2020 and not later than 27 April 2020 in Warsaw, seeking to have these authorities commit a prohibited act, by urging these authorities to make public statements available Post of the Polish SA individual data of voters containing delicate data of citizens of the Republic of Poland, specified as PESEL, names and address of residence, despite the fact that Poczta Polska SA was not an entity entitled to request and process this data, i.e. to act with Art. 18&2 kk in accordance with Art. 107(1) of the Act of 10 May 2018 on the protection of individual data.
  • Overshooting of powers and failure to fulfil duties between 1 March 2020 and 10 May 2020 in Warsaw by public officials: The Prime Minister and individual members of the Council of Ministers, Members of the president of the Republic of Poland and the president of the PiS Party, and by the PiS Party, by making preparations for holding the 2020 presidential elections in the form of correspondence and breaking the rules of the Electoral Code, acted against the public interest, i.e. for the act of Art. 231&1 kk.
  • Overshooting of powers or failure to fulfil duties between 1 March 2020 and 10 May 2020 in Warsaw by public officials, including the Minister of State Acts, the Marshal of the Sejm, the unestablished members of the Council of Ministers or another public officers, consisting in the failure to condemn elections to the office of the president of the Republic of Poland designated on 10 May 2020 to the detriment of public and private interests.
  • Failure by a public officer of the Minister of State Assets in the period from 6 April 2020 to 19 May 2020 in Warsaw, consisting in the failure of the applicable implementing acts to the Act of 6 April 2020 on peculiar rules for the conduct of general elections to the president of the Republic of Poland before the date of the elections ordered for 10 May 2020, which was to the detriment of the public interest, i.e. to act with Article 231& 1kk.
  • Overshooting or failure to fulfil duties on 6 May 2020 in Warsaw, by MP and president of the PiS organization and organization president An agreement by their ‘’agreement’ under which no elections were held for the president of the Republic of Poland on 10 May 2020, which was to the detriment of the public interest, i.e. to act under Article 231&1 kk.
  • Measures taken in the period from an unset date to May 10, 2020 in Warsaw to change the constitutional government of the Republic of Poland, by Members, members of the government, the president of the Republic of Poland, including on May 6, 2020, by the president of the PiS organization and the president of the organization Agreement, in agreement with another persons, the activity aimed straight at achieving this objective, which was to prepare presidential elections in a manner inconsistent with the Constitution- and to sign a letter containing a ‘solution’ in its content which guarantees Poles the chance to take part in democratic elections ‘’, i.e. to act in accordance with Article 127&1 kk.
  • Disturbing by trickery in March 2020 until May 2, 2020 in the territory of the Republic of Poland the danger to the life or wellness of many people for property in large sizes, causing an epidemiological threat by organising elections to the office of the president of Poland ordered on May 10, 2020, i.e. to act with Article 165&1 point 1 kk.
  • Disturbing by trickery on May 10, 2020 in an unestablished place in the free exercise of the right to vote, voting for votes, drafting electoral protocols in the election of the president of the Republic of Poland ordered on May 10, 2020 for private damages, i.e. for action under Article 249(2) to (4) (k).
  • Force people entitled on 10 May 2020 in an unestablished place to refrain from voting in the election of the president of the Republic of Poland on 10 May 2020 by abuse of the relation of dependency i.e. by acting 250 kk.
  • Counterfeiting by the Minister of State Acts in an unset place and time, in order to usage for authentic, ballot cards in elections for the president of the Republic of Poland ordered for May 10, 2020 by not placing on them the seal of PKW, the date and red stripes, i.e. the act of Article 270&1 kk.
  • Failure to fulfil its obligations in an unestablished period of no earlier than 5 February 2020 and no later than 10 May 2020 in Warsaw by unestablished PKW members, consisting in taking action to conduct the elections of the president of the Republic of Poland, ordered on 10 May 2020, which was to the detriment of the public interest, i.e. to act under Article 231& 1 kk.
  • It existed in a more indefinite time, not earlier than 5 February 2020 and not later than 10 May 2020 in Warsaw, to usage – in connection with the election of the president of the Republic of Poland – in connection with the election of the president of the Council of Ministers and Vice-President of the Council of Ministers, Minister of State Acts, in order to incorrectly draw up a list of voters, protocols or another electoral documents, by omitting PKW and issuing orders to the boards of companies Poczta Polska SA and PWPW to organise the election of the president of the Republic of Poland in 2020 in the form of a correspondence vote, i.e. an act with Art. 248& item 2 kk.

The territory Attorney's Office in Warsaw refused to initiate an investigation into the uncovering that the act did not contain the signs of a prohibited act. As a consequence of many complex complaints in this case, the territory Court in Warsaw repealed the order of the territory Prosecutor's Office in Warsaw to refuse to initiate an investigation. The Court of First Instance finds that a decision to refuse the initiation of an investigation was issued in the proceedings at least prematurely.

The Court of First Instance, by adopting its decision, recommended to the Public Prosecutor's Office, inter alia:

  • analysis of the findings of the Information/ study on the results of the audit of the preparation of the general elections for the president of Poland ordered on 10 May 2020.
  • take action (IP address of the Polish Post Office, witness statements) to find who sent requests for the release of individual data of voters on 23 April 2020.
  • hearing representatives of PWPW SA and Poczta Polska SA, in order to establish legal awareness and the fact that decisions were made.
  • the proceeding of the Minister of Digitization, Minister of State Acts, representatives of the Polish Post Office,
  • examining the decisions of the Provincial Administrative Court and many another complicated procedural acts.

This issue is undoubtedly controversial due to the scale of possible irregularities in organising the May 2020 presidential elections and the importance of the celebration of democracy, namely the electoral act and the organisation of the electoral process. This process must be free of any irregularities, in which case the territory Court in Warsaw repealed the order of the territory Prosecutor's Office in Warsaw stating that during the process leading to the elections which took place, it could have been adequate for gross irregularities, thus ordering many procedural actions. The list of irregularities during the organisation of the enveloped elections is impressive, but it should be borne in head that the Public Prosecutor's Office is dependent on the Minister of Justice, who is part of the power, has made decisions on the enveloped elections. For this reason there may be doubts about the destiny of the case in which the individual data of millions of Polish citizens may have been leaked.

Two years after the election that did not take place, the substance takes on a fresh meaning, namely the question of whether individual data could have been taken over by a abroad interview. It is worth recalling that a fewer weeks ago Poland expelled an agent of the Federation of Russia, who operated in the Office of civilian State in Warsaw. So the question arises as to whether in 2020 Poczta Polska SA had the means and chance to prevent infiltration by Russia's intelligence, in order to intercept the individual data of millions of voters?
