Council of Ministers took care of Draft amendment of the Act on wellness protection against the effects of tobacco use.
The case has become a social one. This universal access began to constitute serious threat, not only in Poland. Changes in the e-cigarette market. Council of Ministers adopted the amendment
– I am pleased to inform you that the Council of Ministers has adopted an amendment to the wellness Protection Act against the consequences of tobacco usage and tobacco products. In fact, We are talking about 2 amendments, they are separated due to the fact that 1 is the implementation of the EU Directive – the head of the wellness department forwarded during a press conference held on Tuesday.
As Isabella Lestin stressed, the bill is highly crucial due to the fact that it concerns the wellness of children and young people. She pointed out that for respective months now there has been information that children smoke electronic cigarettes without nicotine, but to delusions resembling real e-cigarettes. – You can buy them in vending machines located close to schools and in all stores said the Minister of Health.
She stated that the fresh government was intended to prevent “the evil phenomenon of getting utilized to smoking by a very young man”. Leschina informed that the bill adopted by the RM bans the sale of electronic cigarettes without nicotine and nicotine bags to children and adolescents under 18.
In addition to the following restrictions, as Isabella Lestin explained:
- limit the places where these products can be used, as in conventional and electronic tobacco regulations
- ban on the sale of these products in vending machines and distance sales, including via the internet
- prohibition of advertising and promotion of these products
- need to study the composition of the liquid contained in the articles to the president of the Office for Chemical Substances
- the request to adapt the composition of the liquid contained in the articles to the applicable government (it must not contain substances with CMR properties – carcinogenic, mutagenic and adversely affecting reproductive health)
– In a word, we introduce non-smoking cigarettes rules precisely the same as for nicotine, but that we completely prohibit the sale of them to children and young people and introduce the request for appropriate labelling of packages. It must be written in a black font of a certain size on a white background, that it is simply a product harmful to health," summed up Isabella Leschina.
Nicotine bags with additional regulation
The Minister of wellness indicated that all the above regulations concern both electronic cigarettes and nicotine bags. However, for the second there is another regulation – the nicotine concentration in the product must not exceed 20 mg/g.
Leschina announced that the bill would be notified for a three-month period and then, as she argued, would be approved by the Sejm, the legislature and the President. – I'm certain There will be no political discussion here. Children are the most crucial and we all want to defend the wellness of the youngest, so the Sejm adopts this bill, the Senate, the president will surely besides want to defend the children," she explained.
The Minister besides added that importers can number on a six-month adjustment period for the preparation and information of product composition rules.
The second amendment to the law is the implementation of the EU Directive on aromas in e-cigarettes. – Manufacturers and importers of innovative tobacco products will not be able to add to them alleged characteristic aromas, i.e. those who sell, produce, place these heated tobacco products on the market, will not be able to introduce these products with various aromas pretending to odor like fruit and taste like candy, due to the fact that we all know that it is simply a health-threatening nicotine product," explained the Minister of Health.
