The case concerns the charges concerning the illegal usage of Pegasus software and disclosure of operational control materials that were to include Giertych's 2019 talks with Donald Tuski.
"The MP did not appear in the prosecutor's office today; no actions were carried out with him, but he duly justified his absence," said prosecutor Elżbieta Edyta Łukasiewicz, spokesperson for the territory Attorney's Office in Ostrołęka.
The Pegasus and Roman Gierty affair
The notification that Giertych made concerns a suspicion that the powers of public officials were being exceeded. They were to illegally eavesdrop the lawyer's and politician's conversations with Pegasus and then transmit the recordings to unauthorized people.
– Overshooting of allowances was to take place between June and December 2019 by illegally obtaining information utilizing Pegasus software, and then handing over to unauthorized people recordings of conversations between Roman Gierty and Donald Tuski, which officers acted against private and public interest," explained Prosecutor Łukasiewicz.

In his notice, Giertych besides pointed out tv Republika journalists, accusing them of disclosing the content of recordings on air and on the station's website on 14 June. It is about the publication of excerpts of the conversation with Donald Tuski, which active e.g. electoral lists and talks with the then PO leader, Grzegorz Schetyna, in the context of the start of Giertych in parliamentary elections.
The recordings were published by right-wing media: tv inPoland24 and tv Republika.
The investigation conducted by the Ostrołęc Prosecutor's Office besides includes a announcement submitted by the CBA. Its content has been classified, so, as the spokesperson pointed out, the prosecution does not supply detailed information on its content.
