Thousands of seniors who have taken advantage of early retirement opportunities in the past can shortly number on equalization. The government is working on a alleged "repair law" that will let their benefits to be recalculated. All due to the unconstitutional provisions in force since 2012, by which the pensions paid were underpaid.

Reduced pensions despite the right to full benefit

The problem concerns people who decided to quit early before 6 June 2012. After reaching the general retirement age, their benefits were automatically reduced by the sum of earlier payments. specified a mechanics operated under Article 25(1b) of the Pension Act. The Constitutional Court ruled in mid-2024 that this provision was incompatible with the Constitution, but despite the judgment, there were no legislative changes yet.

Only 1 year was equalized

Until now, only persons born in 1953 – mainly women – could number on compensation. another years inactive receive under-retirement. Although the announcements of change had already appeared earlier, seniors are afraid that the case will be postponed again for years. Especially as the budget bill for the current year does not take into account the funds for possible increases.

Draft law in the list of government works

The Deputy Minister of the Family, Sebastian Gajewski, confirmed that the bill had already been included in the list of legislative work of the Council of Ministers (position UD204). The amendments are to apply to insured persons who retired early before 6 June 2012 and acquired the right to a general pension after that date.

The aim of the fresh rules will be to reconstruct the equitable calculation of benefits without deducting previously paid amounts, which will be in line with the Court's ruling.

ZUS will number the pension itself – without application

The good news for elder citizens is that the Social safety Office will be required to automatically recalculate pensions – without having to apply for them. According to Gajewski, benefits are to be determined ex officio on the date of entry into force of the fresh law.

The recalculations will besides cover all the assets due, so that the amounts of payments can increase by up to respective 100 PLN per month.

When will the “Repair Act” enter into force?

Although the government is working on regulations, the date of their entry into force has not yet been specified. It is realistic to anticipate that the fresh regulations will enter into force at the earliest in 2026 – since the budget for 2025 does not take into account the appropriations for the payment of compensation.
