Judgment on the Polish Constitutional Court.

The Court of Justice in its judgement delivered yesterday stated that The Polish Constitutional Court violated respective principles of Union law. He ruled that the TK was not independent due to irregularities in the appointment of 3 of its members and its president. According to the judgment, Poland is obliged to respect the common values enshrined in Article 2 of the Treaty on European Union, including: the regulation of law, effective judicial protection and the independency of the judiciary.
