Although Holovnia signed the order on December 21, PKW noted contradictions in the ultimate Court's resolutions. The Marshal of the Sejm sent a letter to the PKW concerning the filling of mandates after erstwhile PiS MPs to be replaced in the Sejm. Candidates are chosen from among the letters from which Kamiński and Wąsik competed, taking into account the criterion of the largest number of votes.
The doubts of the State Election Commission arise from the fact that in the case of Kaminski's mandate 2 chambers of the ultimate Court: the Extraordinary Control Chamber and the Labour Chamber ruled. The first took into account the complaints of politicians, stating that they were both inactive Members. The second, a fewer days later, rejected Kamiński's appeal against Holowna's decision, considering that his mandate had expired. She besides pointed out that decisions of the Extraordinary Control Chamber were invalid and that it is not a court itself, which confirms a number of legal authorities and the Court of Justice of the European Union.

In response, PKW asked the marshal whether he maintained his proposal. If the Holovnia maintains its decision, it will be required to present to the PKW the ‘actual and legal basis on which the proposal is based, since the ultimate Court's provisions are contradictory’. PKW explained that the decision of the talker of the Sejm had been issued before the ultimate Court decided in January, so the aim is to get a current position on the extinguishing of the mandates of Kamiński and Wąsik.
The fundamental question relating to the substance is: do Wąsik and Kamiński inactive service as MPs? The Marshal claims that he effectively completed their mandates and announces that he would urge the Bureau of the Sejm to not issue entry cards at the forthcoming gathering of the Chamber which runs from Thursday to Friday.
