The prosecution conducts investigations after disclosure of a fragment of the video from Jarosław Kaczyński's proceeding on 2 towers. According to the WP and Facts accounts, investigators indicated that Roman Gierty had access to the full file as a proxy for Gerald Birgfellner. Gierty denies and claims that the prosecution's suggestions are unjustified. In a state of law, leaks from the files cannot be a political tool of the game.

According to a media report, the D.A.'s spokesperson pointed out that Roman Gierty, lawyer for Gerald Birgfellnner, had access to the full file. Gierty himself rejected specified suggestions. In his interview with the Fact, he claimed that the prosecution had access to the file also, and he found it unjustified to indicate him.
The files are not fuel for media warfare.
The case has a clear political burden. Jarosław Kaczyński is the leader of the PiS, Roman Giertych MP KO and 1 of the most fierce opponents of the right-wing camp. In specified a system, all leak immediately becomes ammunition.
That is why the standard should be higher, not lower. The files of proceedings are not material for online performances. If the recordings from the hearings come to the media, the citizen has the right to ask whether the institutions of the State are in control of their own procedures.

It must not be determined who is liable for the disclosure of the material. For this there are checking activities and possible proceedings. But the D.A. needs to remember that her communications can't look like a public indication of the guilty individual before establishing the facts.
For Poland the stake is wider than the Kaczyński-Giertych dispute. If political affairs files begin to live their lives, trust in justice is weakened. And without that, the state becomes a tool for fighting the faction, not a guardian of the law.
