
In just a small over 2 weeks, we will know the ultimate Court's decision on the validity of the presidential election. Meanwhile, the National Election Commission adopted a study on this year's election, which will then be sent to SN. The study contains an amendment by lawyer Ryszard Balicki, who demanded that "incidents which could affect the result of the elections be taken into account". The study was supported by a majority of PKW members.
The State Election Commission adopted the presidential election study by 6 votes to 1. 1 associate of the committee abstained. The study took into account Richard Balicki's amendment, which demanded designation of "incidents likely to affect the result of the election".
"The PCW states that incidents which may affect the result of the vote have occurred during the vote, peculiarly on the day of the re-vote. PKW leaves the ultimate Court with an assessment of their impact on the result of the election of the president of the Republic of Poland" – it is written in the Balicki Amendment.
The amendment mentions, among others, the "use of unauthorized software" by any members of the electoral commissions. It is most likely about the alleged Matecki app, which was intended to verify certificates of voting rights. The amendment besides draws the court's attention to the "repeated errors" of the committee by misallocating the number of votes to individual candidates.

The ultimate Court, to whom the study will be transmitted, will decide whether or not the election incidents truly affected the result of the elections.
Under the law, the ultimate Court has 30 days to give a decision on the validity or nullity of the elections – after having examined all electoral protests on the basis of the study of the State Electoral Commission. On Monday, June 16, the “Onet” service informed that about 3,000 had already received specified protests to the ultimate Court. That's about 2,000 little than 5 years ago, erstwhile they were placed over 5,000. The most electoral protests were received by the SN after the 1995 election. There were almost 600,000 of them back then!
The validity of the presidential elections in Poland will be decided by the SN by 2 July of this year.
