According to car Świat, the Ombudsman (RPO) is constantly affected by complaints about the rules applicable in the areas of paid parking. The top doubts arise from additional charges, which are sometimes highly high. A major problem is that any drivers only learn about them after a fewer months erstwhile they receive a call for payment. Then they gotta face the debts of thousands of zlotys. This was the case with the author of 1 of the complaints, who only learned about his debt after 10 months and then had to pay PLN 14 thousand.

The penalties imposed on drivers rise doubts about the Ombudsman, who draws attention to Article 31(3) of the Polish Constitution. It states that restrictions on rights and freedoms should be proportionate to the objective. In the case of additional charges in zones, their amount is not adapted to the gravity of the infringement and the material situation of the perpetrators. Moreover, if drivers want to appeal charges imposed, they must give full bank statements to the authorities - even for the full year. According to the RPO, this is simply a crucial violation of the GDPR principles. specified a request goes beyond the information essential to measure the appropriateness of redemption, which violates Article 47 of the Polish Constitution, which guarantees the protection of privacy.

In connection with specified many complaints, the deputy RPO - Stanisław Trociuk - asked the Minister of Infrastructure Dariusz Klimczak to amend the regulations. According to Interia, he proposed, among another things, to set a maximum amount of additional charges in proportion to the parking rate and lower fees for pensioners, students and people with disabilities. Stanislaw Trociuk besides calls for the work to inform the owner of the vehicle rapidly about the charge imposed and to introduce a 14-day time limit to lodge an appeal against the additional fee, taking into account mitigating circumstances.
