In March 2025, 1 of the most shocking road accidents in Elbląg occurred. On Grunwaldzka Street, a 37-year-old female tragically died, all due to a man who decided to sit behind the wheel despite being banned from driving and drinking. As a result, he led to a disaster that killed an innocent passenger.

Tragedy at Grunwaldzka Street – 3 promiles, ban on driving and death of a woman

On March 12, 2025, an accident occurred at the time of the injury, the effects of which proved irreversible. A passenger car, led by 37-year-old Dmytro D., a Ukrainian citizen, left the road and hit a light signal pole. As a consequence of the impact on the site, the vehicle passenger, 37-year-old Svietlana B, died.

Svietlana B. died of violent death as a consequence of extensive, severe and multiple bodily injuries – informs prosecutor Ewa Ziębka, press secretary of the territory Attorney's Office in Elbląg.

The investigation showed that the man was in a state of considerable intoxicated state – in his blood he had 3.03 alcohol. In addition, he was driving at a velocity exceeding average – over 90 km/h – and did not fasten his safety belts. Furthermore, Dmytro D. did not even have the right to drive, as the court had previously ruled against him a ban on all types of mechanical transport.

Car without approval of the owner

Not only the deficiency of rights and alcohol influenced what happened. As determined by the investigator, the car that the unsub was moving was not his. A man "borrowed" it from a repair workshop in Władysławów close Elbląg under the pretext of short-term use. Without the consent of the owner and without work for the consequences, the passenger besides entered a deadly trap.

Dmytro D. confessed

During the proceedings, Dmytro D. was questioned twice. During the interrogations, a man confessed to all the charges. The indictment has already gone to the Elbląg territory Court, where the trials will begin.

The suspect will answer for 3 crimes:

  • causing a fatal accident in an intoxicated state,
  • driving despite a judicial prohibition,
  • and illegal short-term usage of individual else's vehicle without the consent of the owner.

For the most serious charge—the death of a man as a consequence of driving under the influence of alcohol—he is facing 5 to 20 years imprisonment.

For now, the man remains in temporary custody.

Criminal law and jurisprudence – precedents in specified cases

In the Polish Criminal Code, Article 168 § 1 point 1 refers to the anticipation of punishing even a life conviction in cases where the killing has occurred in conditions of peculiar danger to the life or wellness of many people, e.g. as a consequence of violations of traffic regulations.

Although there is no intention of action in this case, the facts of disregarding life are apparent – a state of intoxication, a ban on driving, inadvertent usage of individual else's vehicle and utmost velocity – may origin the court to consider the action to be peculiarly heavy.

The case law of the National Bar Association and the Constitutional Court indicate that courts are increasingly applying stricter penalties in cases of fatal accidents caused by driving under the influence of alcohol, especially erstwhile perpetrators were previously punished or banned.


Political negligence: Who is liable for the threat on Polish roads?

Unfortunately, cases like this are not isolated. The preservation of any Ukrainian citizens, which pose a threat to the safety of Poles, is mostly the consequence of the policy of the Law and the current coalition.
