On Monday, May 19, 2025, Warmian-Masurian Voivodeship became the arena of another case of serious violation of border law by alleged refugees from Ukraine who were admitted to the country by the Law and Justice Office in agreement with the current dinner. Officers of the Warmia-Masurian Border defender Division (W-MOSG), in cooperation with the Police of the territory Command in Pisz, detained a Ukrainian citizen suspected of transporting 4 foreigners from Somalia who were illegally residing in Poland.
Road control reveals illegal passenger transport
The event took place on national road No. 58. Information about the fishy vehicle was received from the applicant. An immediate police action began – the police stopped Volkswagen for individual control. There were 4 men from Somalia in the car, apart from the driver, a Ukrainian citizen.
During the intervention, it appeared that the vehicle manager had no papers stating his driving licence, registration card or OC policy. Furthermore, the travellers did not have any papers to authorize legal entry and stay in the Republic of Poland.
Border procedures and judicial decisions
After establishing the illegal entry of foreigners into Poland, border guards took action in the field of readmission. 4 Somali citizens were transferred to applicable services in the Republic of Lithuania, most likely from where they reached the European Union.
On the another hand, a Ukrainian citizen was accused of organizing foreigners crossing the state border against regulations. According to the territory Attorney's Office in Pisz, the court applied a precautionary measurement in the form of a provisional arrest for 3 months. According to the Penal Code, six months to 8 years of imprisonment is punishable for specified action.
Border law and jurisprudence – how is that relevant?
In accordance with Article 371(1) of the Criminal Code:
‘He who organises or directs the crossing by a foreigner of the state's border against the laws shall be subject to imprisonment from 6 months to 8 years.’
The jurisprudence of the Constitutional Court and the European Court of Human Rights have repeatedly stressed the importance of strict enforcement of border law, in peculiar in public safety and public order situations.
By judgement of 17 October 2023 (Event III SK 1:23) The ultimate Court stated that the activities of organising the illegal entry of foreigners constitute a crucial violation of global law and obligations under the 1951 United Nations Convention on Refugees and its 1967 Protocol.
Political negligence: Who is liable for the threat on Polish roads?
Unfortunately, cases like this are not isolated. The preservation of any Ukrainian citizens, which pose a threat to the safety of Poles, is mostly the consequence of the policy of the Law and the current coalition. In February 2022 under the pretext of helping “war refugees”, without appropriate control and verification, thousands of people were admitted to Poland, including those with dubious reputation.
Both the erstwhile Government of the United Right and Donald Tusk's current cabinet, have underestimated the problem, treating him as irrelevant or trying to quiet him down. alternatively of effective solutions, specified as tightening border controls or consistent expulsion of perpetrators, we are dealing with silence and fake actions.
Meanwhile, Poles must bear the consequences of these negligencees. Do we truly gotta wait for further tragedies to get the authorities to take citizens' safety seriously?
