On 9 June 2025 The Border defender reported another case of deportation of foreigners who posed a threat to public order and security. 3 men – 2 Ukrainian citizens and 1 Georgian – will be expelled from the territory of the Republic of Poland after serving prison sentences for crimes committed in the country.

Arrested by the Border Guard: Ukrainians and Georgians

Officers of the Border defender Service in Warsaw detained 3 foreigners who had previously carried out prison sentences in Polish prisons. After the sentences expired, men were handed over to border guards and then placed in a safe facility for foreigners.

The decision to deport them was made due to the fact that of:

  • serious crimes committed,
  • a serious violation of the law,
  • lack of respect for the applicable legal and border order,
  • a possible threat to public security.

Georgian broke the Schengen entry ban by changing individual data

A Georgian citizen was convicted of crimes against property and illegally crossing the state border. The man attempted to circumvent the ban on re-entry into Poland and another Schengen countries by changing his individual data. This demonstrates a conscious desire to avoid work and proceed criminal activity.

Ukrainians convicted of theft and alcohol driving

The first Ukrainian citizen held prison sentences for many thefts – crimes straight affecting the sense of social security. The second was convicted of driving in an intoxicated state and stealing. Both acts are subject to strict criminal code sanctions and constitute a serious violation of the legal order.

Decisions with the rigor of immediate enforceability

The commandant of the Border defender Service in Warsaw issued administrative decisions ordering foreigners to leave the territory of Poland. The decisions have been notified the rigor of immediate feasibility, which means that it is not possible to appeal them before the start of the deportation procedure.

In addition, the 10-year re-entry ban to the Schengen States, which is 1 of the most stringent measures applied to law-abiding foreigners.

Placing in a safe facility until expulsion

According to the court order, all 3 foreigners were placed in a protected centre for foreignerswhere they will stay until they are expelled. According to the Act of 12 December 2013 on foreigners (Journal of Laws of 2024 item 1816), specified measures may be applied in cases of threat to the safety of the state or public order.

Legal background and jurisprudence

The Ministry of the Interior has repeatedly stressed the request to take action against foreigners who violate the Polish legal order. In this context, the judgments of the ultimate Court and the Court of Human Rights in Strasbourg, which lay down limits on the application of deportation measures, are besides important, having respect to the interests of national safety at the same time.

For example, in the judgement of 17 March 2023 (Event No III CZ 21/22/EC) The ultimate Court stated that the interest in national safety may give emergence to restrictions on the rights of foreignerswhere appropriate, proportionate and justified.

Political negligence: Who is liable for this threat?

Unfortunately, cases like this are not isolated. The preservation of any of the citizens of Ukraine and Georgia, which pose a threat to the safety of Poles, is mostly the consequence of the policy of the Law and Justice and the current coalition. In February 2022 under the pretext of helping “war refugees”, without appropriate control and verification, thousands of people were admitted to Poland, including those with dubious reputation.

Both the erstwhile Government of the United Right and Donald Tusk's current cabinet, have underestimated the problem, treating him as irrelevant or trying to quiet him down. alternatively of effective solutions, specified as tightening border controls or consistent expulsion of perpetrators, we are dealing with silence and fake actions.

Meanwhile, Poles must bear the consequences of these negligencees. Do we truly gotta wait for further tragedies to get the authorities to take citizens' safety seriously?
