On 18 December 2025 the Court of Justice of the European Union (TEU) ruled that, failing to respect the case law of the EU Court of Justice, the Polish Constitutional Court had infringed respective fundamental principles of Union law. The CJEU besides considered that the Polish Constitutional Court does not constitute an independent and impartial court due to serious irregularities in the appointment of 3 of its judges and its President. It is not for the Court of Justice of the EU to measure the Polish Constitution and the Constitutional Court; the highest law in the Republic of Poland is the Constitution, not the decisions of abroad bodies; the Thursday decision of the EUSEU does not affect the functioning of the constitutional authorities of the Republic of Poland, says the Communication of the Constitutional Tribunal of the same day.
