The announcement was published Wednesday afternoon on the Court's authoritative website and platform X. "The decision of the Minister of Justice Waldemar Żurek on the suspension of my wife, Magistrate Hencel-Świętzkowski Judges in acting as president of the Court and the initiation of the appeal procedure 3 months before the end of her last word is individual and a manifestation of revenge" – we read.
The Minister of Justice suspended the wife of the TK president
Bogdan Święczkowski further states that this action is "totally illegal". He besides referred to the Constitutional Court judgement of 16 October 2024 (Event No K 2/24).
He pointed out that "no another reasons justify the decision of the Minister of Justice Waldemar Żurek". According to the president of the Constitutional Tribunal, Żurek is guided by "a smallness, retaliates for the activity of the Constitutional Court" and hits the Święczkowski family.
The Ministry of Justice did not state the authoritative reasons for the suspension of justice Hencel-Świętzkowska. She served as president of the Sosnowiec Court from 1 November 2017, erstwhile she was appointed by then minister Zbigniew Ziobro.
Bogdan Święczkowski thinks it's "revenge" Żurek
Gazeta Wyborcza recalls that the appointment of Małgorzata Hencel-Świętzkowski caused quite a few emotions in the judicial community, due to the fact that her husband, Bogdan Święczkowski, was then the closest associate of the Minister Ziobra. Both gentlemen studied law at the Jagiellonian University.
Święczkowski started at the territory Prosecutor's Office in Sosnowiec and the territory Prosecutor's Office in Katowice. Then he went to the National Prosecutor's Office, where he interrupted his career for a year, in order to service as Head of the interior safety Agency from 2006 to 2007.
After the fall of the government of Jarosław Kaczyński in 2007, the 40-year-old then Święczkowski went to rest, and in 2011 he competed from the letter of the PiS to the Sejm. He did not take the mandate due to the fact that he did not renounce the position of prosecutor. After subsequent elections in 2016, he returned to the D.A.'s office as head of the National Prosecutor's Office.
On February 8, 2022, the Sejm appointed him to justice the Constitutional Court. According to any experts, this appointment was contested due to doubts about the composition of the General Assembly of the TK judges, which recommended candidates to the President.
Judge Margaret Hencel-Swięczkowska received a judicial nomination in October 1999 from president Aleksandr Kwasniewski, having previously ruled as an asessor.
