The Sejm passed a bill on the transfer of military equipment

The Sejm passed an amendment to the Act on the Military Property Agency. The regulation will let the Agency to transfer or sale military equipment and ammunition free of charge to the armed forces of abroad countries.

411 Members voted in favour of the amendment, 17 opposed, 2 abstentions. The amendment of the Confederation, which wished that the transfer or sale of the military equipment to another country should be possible only after obtaining the opinion of the Sejm's defence committee, was rejected.

The amendment of the Military Property Agency (AMW) Act provides that the Agency will be able to transfer or dispose of another states' armed forces free of charge of movable property of the Treasury or dual-use items (i.e. military and civilian applications) and weapons. AMW will act on the basis of a resolution by the government on this substance by the Minister of National Defence or the Minister of Home Affairs and Administration. The intent of the changes is to relieve the military from these tasks and to transfer them to the Military Property Agency as a specialist in military equipment and ammunition.

What's it gonna look like?

The value of the transferred property, including free of charge, shall be determined at marketplace value taking into account physical or economical consumption resulting from method and economical progress. In the event of the disposal of property, in addition to its value, the price may besides include the amount of the costs incurred by AMW, the amount of taxes and the amount of expenditure incurred in investigation and improvement of the property being disposed of. The Agency shall find the value of the property transferred and the price of disposal in agreement with the applicable organisational units subordinate to the Minister of National Defence or to the Minister competent for Home Affairs or supervised by them.

The amendment further clarifies the provisions on AMW tasks. The aim is to indicate that these tasks include organizing jointly with or supervised by the Ministry of National Defence as co-operating entities, projects related to the promotion of the Polish Armed Forces, including air shows. In order to carry out these tasks, the Military Property Agency will be able to conclude agreements, in peculiar with local government units, government administration, NGOs, universities and investigation institutes and entrepreneurs.

The bill will now be addressed to the Senate. The provisions are to enter into force 14 days after publication in the authoritative Journal.
