The regulation of law cannot be based on lawlessness caused by the Law and Justice Governments.

These rulings clearly point to the flaw of the alleged fresh National Judicial Council, both in terms of its independency and in its function in the process of appointing judges. Consequently, decisions taken with the participation of the neo-KRS have no legal power and the persons designated by it have not been effectively appointed as judges.

But let us not delude ourselves – if Donald Tusk decides to take this step, and Jarosław Kaczyński comes to power again, there may be a complete stubbornness of the judiciary. The judicial strategy can be transformed into a tool of political influence, and chaos and lawlessness can scope a scale not yet known in the 3rd Republic.

But do we have an alternative? Can we proceed to tolerate the existence of the neo-KRS, the mockery of the Constitutional Court subjected first to the discovery of social, protege, Przyłębska Julia, and now the ass of Ziebra Świętczkowski?
Can we turn a blind eye to the fact that the president of the ultimate Court is the neojudge Margaret Manowska – established in violation of both constitutional standards and global standards of the regulation of law?

The regulation of law cannot be based on lawlessness caused by the Law and Justice Governments. If we want to rebuild independent judiciary and reconstruct constitutional order, we must act decisively and responsibly. The postponement of decisions only leads to further erosion of the foundations of democracy and failure of public assurance in public institutions.
