Bodnar reported on platform X that the proposal for the erstwhile Prime Minister was placed on the desk of Marshal Simon Holownia. It concerns the Sejm's consent to bringing PiS MP Mateusz Morawiecki to criminal work in connection with the 2020 alleged correspondence election. The details of the basis of the motion at the press conference were discussed by prosecutor Anna Adamiak from the National Prosecutor's Office:
The application was formulated in the proceedings, conducted in the territory Attorney's Office in Warsaw. This is an investigation that was initiated in October 2020 and the subject of this investigation is to measure whether public officials active in the process of organising the 2020 presidential elections in Poland have exceeded their powers or failed to fulfil their duties.
In the case, according to Anna Adamiak, extended evidence was collected, including many papers sent by the alleged commission to analyse the envelope scandal. The scope of proceedings is very wide, and a squad of 4 prosecutors is working on the case.
Main charges
Prosecutor's Office accuses Morawiecki that as Prime Minister he has exceeded his powers and has taken steps to prepare and hold presidential elections on 10 May 2020 only in the form of correspondence. According to the prosecutor's office, he did so despite deficiency of adequate legal competence and receiving negative legal opinions. For this purpose, he utilized the Act of 2 March 2020 on circumstantial solutions related to the prevention of COVID-19, which, according to the National Prosecutor's Office, did not constitute a basis for action.
Prosecutor Anna Adamiak notes that the bill entered into force on 9 May 2020, while Morawiecki already issued 2 decisions on 16 April 2020. The first active the Polish Post Office, ordering it to take action to organise the presidential elections in correspondence form, and the second afraid the State safety Printing Works, ordering it to start printing ballot cards and another essential electoral documents. According to the prosecutor's office, these decisions were incompatible with the applicable rules governing the electoral process in Poland, including the Electoral Code, and violated the competences of the respective state authorities specified as the State Electoral Commission and the National Electoral Office.
Adamiak besides informed that Morawiecki was accused of Article 231 §1 kk in connection with Article 12 kk, which entails a punishment of up to 3 years imprisonment. She added that if the prosecutor investigating the envelope election finds that Morawiecki's decision was taken in advance, and there is simply a circumstantial chronology of events, the punishment may be much higher.
