“The Prime Minister had no legal basis to organise the May 10 presidential elections,” says Marian Banas president of NIK. The ultimate Audit Office has made 2 applications to the D.A. on this matter, but so far they do not concern the highest officials in the state, but only the boards of 2 companies. Why? Officially, the NIK does not have all the information yet, but it seems that Banas does not want to present the largest department to the government, alternatively he decided to play a political game with him.
And this unfortunately does not show Banasa in the best light, due to the fact that alternatively of the primary independent head of the control institution, who uncompromisingly and courageously points out errors, abuses or even crimes committed besides by the highest government officials with the Prime Minister at the head, and specified obligations are imposed on him by the Constitution – Marian Banas appears to be a clever political player who uses his subordinate ultimate Chamber of Control and its officials.
Perhaps today's press conference is to become the most crucial argument in the behind-the-clock fight between him and Jarosław Kaczyński. It is worth remembering that in the background is the household of Marian Banasia, in peculiar his son, who was targeted by state services most likely in order to effectively lead Banasia to resign. But he hasn't decided to resign yet.
The audit of the presidential elections carried out by NIK clearly showed that Prime Minister Mateusz Morawiecki acted unlawfully, deciding to organise elections on 10 May. The question remains to what degree Morawiecki was aware that he was committing an illegal act. It is certain that the legal expertise available to NIK controllers, to which the Prime Minister may have had access, was at the disadvantage of Morawiecki.
Importantly, the Prime Minister commissioned the Polish Post Office and the State safety Printing Works to organize and implement elections, at the same time government representatives failed to carry out supervision of this decision. On the management of these 2 (PP and PWPW) entities, the NIK reported a legitimate suspicion of a crime.
Among the another entities that participated in the illegal opinion of NIK of the election organization are besides the Ministry of State Acts, the Ministry of Interior and Administration and the Chancellery of the Prime Minister of the Council of Ministers.
It is amazing that no notices were made to the prosecutors, no notices were made concerning Morawiecki, Dworczyk and Sasina, and it would appear that these people were primarily liable for unsuccessful and unlawful presidential elections. At the same time, NIK stated that the State Treasury lost at least PLN 76 million.
There is no uncertainty that the Prime Minister, who is acting against the law, and the control of the NIK asserts this unequivocally – has lost his moral right to exercise office and should be sent to the Court of State to measure his political conduct. However, this does not exclude proceedings before the general court, due to the fact that in the background we have real financial losses. Importantly – Mateusz Morawiecki has bad experiences with common courts, which have already twice stated that the Prime Minister was speaking untruth publicly.
On the another hand, Marian Banaś, who is now attempting to endanger the ruling finger again, suggesting that he may make further reports to the prosecution in connection with the abuse of powers and the failure of ministers, while not making authoritative reports on the matter, opens up a space to consider whether he himself will gotta face akin allegations in a certain time.
