Despite the deficiency of open public consultation on the bill, IAB considered it appropriate to present a position on the proposed amendment of the Penal Code for Penalisation of alleged patostreaming.
We see the social importance of the problem to be addressed by the proposed regulation. The publication on the net of content showing violence, humiliating another people or harming animals should not be accepted. At the same time, the task concerns the public dissemination of content in the ICT network, i.e. the area covered by IAB Polska, which includes the digital communications market, net advertising, publishers, web developers, platforms and another participants in the online services ecosystem. It is so crucial that the rules on combating patostreaming are precise and proportionate and do not lead to the hazard of criminal liability of legitimate online activities.
