The Ministry of wellness received another petition to ban smoking on balconies in multi-family buildings. The authors of the paper point to serious threats to the current legal state, including passive smoking, littering of common space and fire risk. Will the government take action?
Passive smoking and wellness risks
As reported by the portal naTemat, the main problem is to exposure neighbors to the inhalation of toxic tobacco smoke that enters their homes and onto balconies.
"The vulnerability of others to passive smoking is peculiarly dangerous for children, the aged and the sick. As a result, they cannot freely air their apartments” – emphasize the authors of the petition.
Cigarettes and fire risk
Another argument is the problem of dumping butts, which hit the balconies of lower floors or common areas. It's not only littering space, it's besides a real fire hazard, especially during the summer.
Will the Minister of wellness take action?
The applicants called on Minister Isabella Leschina to take a legislative initiative. If the petition does not contain formal errors, the ministry has 3 months to respond to the case.
Position of the Ministry of Justice
In March 2024, Deputy Minister of Justice Arkadiusz Myrcha responded to a parliamentary interpelling on the matter:
"Tobacco on balconies and terraces has not been compromised under the current legislation".
At the same time, he recalled that the wellness Protection Act against the consequences of tobacco usage guarantees the right to live in a smoke-free environment.
Is smoking on balconies real?
Although current law does not prohibit smoking on balconies, social force increases. Many housing communities have already introduced their own regulations prohibiting smoking in common places. Will the government follow in their footsteps?
