The government plans to amend the Criminal Code, extending criminal liability for LGBT discrimination. The consequences of these actions may be tragic. From the very beginning of her word of office, the left-wing organization has been pushing for stricter rules on hatred speech.
On Wednesday a draft of the Ministry of Justice was published on the pages of the Government Legislative Centre, which aims to amend the Criminal Code in this peculiar area. The task extends the list of discriminatory factors to criteria specified as disability, age, gender, sexual orientation and sex identity.
The amendment of the Criminal Code to extend criminal liability for discrimination against LGBT+ and another groups may give emergence to a broad social and political discussion. For some, this may be a step towards equality and the protection of LGBT+ rights, while for others it may be seen as interference in freedom of speech and thought.

"The introduction of the proposed solutions will supply reinforced and full criminal protection against force or a threat of illegal violence, hatred speech, insulting and violating physical immunity due to disability, age, sex, sexual orientation or sexual identity of the victim", the task states.
The proposed modifications include an extension of the scope of the aggravating factors that the court takes into account erstwhile determining the defendant's punishment (in accordance with Article 53(2a) of the Criminal Code) and an extension of the criminal liability for discrimination (in accordance with Article 119 of the Criminal Code), a "invoking hatred" (in accordance with Article 256(1) of the Criminal Code) and a "injury of the population group or person" (in accordance with Article 257 of the Criminal Code).
Once the changes have been approved, anyone who is allowed to insult a individual due to, among another things, her religion, sexual orientation or sex identity will be subject to imprisonment for up to 3 years.
The smiling censorship of constitutional freedom of speech
Dr. Bartosz Lewandowski points out that the Ministry of Justice is pursuing a left-wing agenda. ‘In accordance with Article 119(1) of the CCC, criminal liability is besides to be imposed on those who apply the “unlawful threat”.’ In practice, this is meant to mean that the threat of initiating proceedings against the “injured” will besides be punished. In his opinion, even quoting the Bible will be considered a crime, for the quote “You will not have intercourse with a man as you have with a woman. This is an abomination" can be considered a call for hatred.

The threat of “catastrophic consequences” can be interpreted in various ways. any may fear that these provisions may be abused to restrict freedom of expression and expression, peculiarly in the context of controversial planet views specified as LGBT+ rights. Others may see these changes as a step towards greater protection against discrimination and violence.
The left usually supports stricter rules against hatred speech and discrimination, while another political groups may be more inclined to keep freedom of expression even in the case of controversial opinions.
Ultimately, the effects of these changes will depend on the way they will be interpreted and implemented in practice, as well as on the social and political consequences. specified changes would require careful debate and consideration of the different viewpoints and consequences for society as a whole.
