The Provincial Administrative Court in Warsaw has issued a breakthrough decision that opens the way for 1 of the most crucial infrastructure investments in Poland. Despite strong opposition from German organisations and parts of environmentalists, complaints about environmental decision to build the Deep Water Container Terminal in Świnoujście were dismissed. It is simply a strategical triumph that can permanently change the power arrangement in the Baltic Sea and challenge German dominance in maritime transport. The government lacks satisfaction and announces that the construction will proceed as planned.

He added that thanks to the fresh capacity of the port, Poland's competitiveness in the Baltic Sea will definitely increase, and the largest container ships in the planet will be able to wrap to Świnoujście. In practice, this means a green light for continuing work and a real chance to meet the deadline for putting the terminal into service in early 2029.

What about the construction? This isn't the end of a legal battle.

Despite the clear triumph of the Polish side in the Warsaw court, it should be remembered that Monday's conviction is not yet final. The parties who made the complaint shall have the right to appeal. This means that the case may go to Chief Administrative Court (NSA)which will constitute the second and final instance at national level.

Although experts measure the chances of the NSA's repeal of the decision as small, especially after specified a unanimous decision of the WSA, the legal way remains formally open. In theory, erstwhile the national way has been exhausted, the case could besides be referred to the European justice system. Nevertheless, the current decision of the court is simply a strong adequate signal that it allows the investor and the government to proceed preparations for building without major obstacles.
