There were irregularities in the number 113 election commission in Warsaw erstwhile the votes were counted. The ultimate Court revealed that Rafał Trzaskowski was wrongly assigned votes to Karol Nawrocki. The differences are crucial – over 150 votes.
On Tuesday, June 24, 2025, the ultimate Court at the secret sitting of the home of Extraordinary Control and Public Affairs examined ballot cards from the peripheral commission No. 113 at Spartanska Street 4 in Warsaw (the Mokotów River). The gathering was attended by representatives of the State Election Commission, the lawyer General and an electoral authoritative representing the National Election Office.
According to the protocol, Karol Nawrocki was to receive 136 votes, while Rafał Trzaskowski was to receive 1774. However, the conversion of voting cards has yielded different results.
Irregularities in voting cards bags
The court noted serious shortcomings in the way the electoral documentation was secured. The authoritative communication indicated that the voice bags contained Unsecured envelopes and ballots entered in bulkwhich is incompatible with the procedures in force.
One of the unsecured envelopes with the name of Karol Nawrocki contained 136 cards, which was consistent with the data from the committee's minutes. However, the problem arose among cards thrown in without envelopes – alleged "flush".
Votes attributed to the incorrect candidate
Additional cards were found among the bulk cards 160 votes for Karol Nawrocki And 3 votes never mind. All these voices were wrongly attributed in the minutes to Rafał Trzaskowski.
After the votes have been calculated and the errors corrected, The number of crucial votes cast on Karol Nawrocki increased from 136 to 296and The number of votes on Rafał Trzaskowski fell from 1774 to 1611.
Importantly, the number of unused votes, voting rights certificates and invalid votes was as documented.
PKW and the lawyer General must address in 24 hours
The ultimate Court has ordered the State Election Commission and the lawyer General to present a position on the case within the one day. It is not yet known whether errors were of a non-accident nature or part of major irregularities.
Legal and political implications – what can correction of votes mean?
Although the correction of the number of votes in 1 committee does not gotta affect the final result of the elections, specified mistakes undermine citizens' assurance in the electoral process. If akin irregularities have besides occurred in another committees, this may be the basis for recalculation of votes on a national scale – or at least for holding electoral protests.
In the light of the Electoral Code (Law of 5 January 2011, OJ 2011 No. 21 item 112, access: ISAP), peripheral commissions are required to carefully safe the documentation and the correct attribution of votes. Any violation of these rules may consequence in criminal consequences and disciplinary liability.
Will the ultimate Court number the votes in another committees?
It is not yet known whether the ultimate Court will choose akin actions in another circuits. However, it is worth noting that the Extraordinary Control Chamber has already conducted proceedings concerning electoral protests and irregularities related to the number of votes. The case of Commission No 113 may so be the beginning of a wider audit.
What's next? Reminder of electoral protest rules
Under Article 82 of the Electoral Code, each voter has the right to study an electoral protest within 3 days of the announcement of the results. The protest shall be examined by the ultimate Court, which shall have the right to annul the consequence in a given territory if a breach of the rules affecting the result of the vote is proved.
Until now, PKW has not commented in detail, but the authoritative position of both the Commission and the Public Prosecutor's Office is expected.
