The court rejected the application for Ziebra. Żurek's people's work contained "many mistakes"

That's not good news for the National Prosecutor's Office. The court refused to enter the alleged forced mortgage in the book of the perpetual home of Zbigniew Ziobra in Jeruzal. The proposal was to contain "number of errors".


Zbigniew Ziobro is suspected of 26 crimes including misappropriation of funds from the Justice Fund and directing an organized crime group. In November, the prosecution requested, among others, temporary detention for the erstwhile minister. It was besides decided to safe his assets.

Therefore, PK wanted to impose on Ziobra's property in Jeruzal a compulsory mortgage of over PLN 143 million, as the cost of crimes accused of the politician was calculated enough.

However, the territory Court of Rawa Mazowiecka has not given permission. RMF FM writer learned that the referee stated that the prosecution's application contained many errors. It took, among another things, claims on the basis of which the mortgage was to be entered and the creditor was not identified. Furthermore, another property belonging to Ziobra was already secured for the same amount of PLN 143 million.

"Under the law, the burden of a compulsory mortgage on more than 1 property of the same debtor requires the division of the collateral into individual partial mortgages, to cover the claims in full" is given.

However, the decision to dismiss the application is not definitive and may be challenged. The PK so has a chance to improve the proposal. It was besides mentioned that Ziobra's property message indicates that the property in Jeruzal is worth PLN 950 thousand.

Let us add that on 22 December the court will decide whether the PiS politician should be temporarily arrested. He is presently inactive abroad. In a message he issued in early December, he announced that he did not intend to return to Poland unless on 1 condition. “I will come back if I have reason to believe that courts operate independently of this authority,” he said.
