This court is the highest expert, and on the basis of the full circumstances of the case, it should measure whether the perpetrator was under influence or after utilizing a measurement another than alcohol," the Constitutional Court stated today. This is 1 of the reasons why the Constitutional Court decided to dismiss a case concerning the problematic provision of a code of offense.
