In the fresh composition of the government led by Donald Tusk, the post of Deputy Minister of Culture and National Heritage was taken by Joanna Scheering-Wielgus, a associate with clear proabortional sympathy, who, together with her husband in 2020, drew attention to herself by disrupting Holy Mass. The question so needs to be raised here on what legal basis, in applying the rule of equality to the law of Holovnia with the aid of Bodnar and the prosecution, is going to hold criminal MP Braun liable for the “distortion of a spiritual act” of religion that is not legally regulated in Poland.
Joanna Scheering-Wielgus, representing the fresh Left (formerly Modern) in the centre-left government, is known for her extremist support for pro-abortion demands and criticism of the Catholic Church and its followers.
In October 2020, during mass protests against the Constitutional Court's decisions on eugenic abortion, Scheering-Wielgus and her husband entered St. James' Church in Toruń while celebrating Holy Mass. Both faced the chancel, holding banners supporting the right to abortion.
As a consequence of this incident, the prosecutor charged the MP with disrupting the service and insulting spiritual feelings. As part of the defence of the MP on the case, the Ordo Iuris Institute joined, arguing that the intrusion into the church not only disrupted the prayer of the faithful, but besides raised concerns about their own safety.
In March 2023, the Toruń territory Court decided to dismiss the case, justifying this deficiency of grounds for the charges. The court did not find Scheering-Wielgus' actions malicious in the context of giving views on the Constitutional Court's decision during the service. The decision of the court did not take into account the position of the victims who requested a court proceeding and the punishment of the Member. The Ordo Iuris Institute stressed that the court disregarded the context of events, especially attacks on churches, believers and clergy in October 2020. Furthermore, it was noted that the court allowed the public to proceed to proceedings, contrary to procedural practice.
It is besides worth mentioning that in 2018 Joanna Scheuring-Wielgus was 1 of 5 MPs who voted against the package of draft amendments to the Act on the Institute of National Memory, including on the penalisation of flagism in Poland. Similarly, Adam Sz Trapka, the current European Union Minister in Donald Tusk's 3rd government, voted.
We would like to remind you that a fewer days ago, with the aid of a fire extinguisher, Mr Braun put out Khanuk candles lit in the Polish Sejm. As a consequence of this incident, Holovnia demanded the prosecution and clothes of the MP. The fresh Justice Minister Adam Bodnar has taken up this task.
It has been reported in the media that the prosecution has initiated an investigation against Mr Braun of its own motion and will request the waiver of immunity.
Prior to Bodnar (supporter of granting Ukrainians the right to vote) informed that Mr Braun would be prosecuted, inter alia, with Article 195 k.k.
In view of this information, is Bodnar acquainted with the penal code? In our opinion, he has a major problem with this, due to the fact that the criminal work for which he wants to be attributed to Mr Braun can only be held liable in the case of a spiritual act on a church or another spiritual union with a legal situation.
We remind you that Chabad-Lubacz does not have a legal situation in Poland, which in fact makes it impossible for Mr Braun to be charged with extinguishing Khanuk candles in the Sejm.
With respect to the another charges led by the Holovnia against Mr Braun, it is noted that the tv fireplace of Holovnia may and was good but for interpreting the law it is better not to be a beier.
The following video shows the course of extinguishing by Mr Braun of the Khanuk candles, which shows that it was not the MP who attacked Magdalena Gudzińska-Adamczyk. The recording clearly shows that it was Magdalena Gudzińska-Adamczyk who violated the physical immunity of the MP.
In this regard, it should be concluded with absolute certainty that Mr Braun has not exhausted the nature of the crime he wants to be attributed to.
