The Bialystok Court of Appeal (II Criminal Division) on 19 August 2025, No. II AKo 91/25, resumed proceedings and waived a life ban on driving a vehicle based on Article 42 § 4 of the Criminal Code. This is the first specified ruling in Poland, based on decisions of the Constitutional Court, beginning the way for individualisation of criminal measures under Article 178a § 4 of the Criminal Code
