Prosecutors from Lex Super Omnia at Pol’and’Rock Festival 2022!

This year for the 3rd time the Lex Super Omnia Prosecutors' Association was present at the World's Most Beautiful Festival – Pol’and’Rock FestivalOh, my God! We were 1 of many NGOs present at the Academy of Fine Arts.

It is clear that music and good fun are the most crucial at the music festival, but for years the festival has been part of the ASP – space for NGOs, activists and volunteers, who have the chance to present their organizations, their tasks and ideas to the festival. Lawyers have been present at the Pol’and’Rock Festival for respective years and each year you can see how crucial our presence there is. It is known that people come to the festival to perceive to music and play, but they have adequate time there to halt by the tents of the organization on the ASP, perceive to activists, talk and participate in workshops, which are respective twelve a day. It is of peculiar importance that the Pol’and’Rock festival is unbilled and that the campsites are free of charge, so that the stay there is available to virtually everyone, besides for people who have limited access to what Pol’and’Rock offers them all year for various reasons. Once again, we have prepared a workshop shelter together with the Bar Association in Warsaw – it has been confirmed that prosecutors and advocates play a large function in conducting workshops together and complementing their conversations with people.

The first day of the workshop in our shelter was about a subject that always sparks interest – Stopping and then what? Prosecutors Dominik Mrozowski and Damian Gałek, lawyer Jarosław Belowski spoke about the rights and obligations of persons detained by the police.

There was besides a debate attended by lawyer Katarzyna Gajniczyk-Pruszyńska – Vice-Dean of the territory Bar Council in Warsaw and prosecutor Mariusz Krasonia, moderated by justice Igor Tuleya, titled,Dignity of the frontier or the limit of dignity“, during which we discussed the situation on the Polish-Belarusian border and whether helping refugees could be considered a crime. Participants tried to answer the moderator's hard questions: whether it is legal to supply assistance, whether there are limits to this aid, why the presence of a typical at the border matters, whether any individual crossing the border should be given global aid and why we see fundamental differences between the state's proceedings at different borders.

On the next day, lawyer Marta Tomkiewicz-Januszewska and prosecutor Małgorzata Ceregra-Dmoch successfully conducted an educational quiz about the law with awards “Borders of civilian libertiesIt’s okay. ”

A large audience was attracted by the debate “Are there limits to the regulation of law” attended by Prof. Adam Bodnar, erstwhile Ombudsman, lawyer Mikołaj Pietrzak, dean of the territory Bar Council in Warsaw and prosecutor Mariusz Krasoń, vice president of LSO. The debate was moderated by Proc. Piotr Wójtowicz. Lawyers “human” spoke about what the regulation of law is. Prof. Adam Bodnar pointed out that we meet in a joint shelter of prosecutors and lawyers who together present their organizations at the festival, and even 5 years ago specified activity of lawyers was controversial. Adv. Mikołaj Pietrzak recalled the function of the Constitutional Court, which should be a courageous and wise court and set limits to the legislature, protecting the Constitution. That's why we're so worried that that Constitution defender is missing. Proc. Mariusz Krason said that the Constitution should defend a number from the undemocratic urges of those who won the election. Prof. Adam Bodnar stated that erstwhile the Constitutional Court does not work, another institutions and forces are called up – citizens claim their rights, the RPO operates, judges exercise distributed constitutional control.

The next workshop in our attorney-at-law shelter afraid the subject “Borders of the prosecutor's participation in public lifeIt’s okay. ” It was conducted by prosecutors Aleksandra Malinowska-Bizon and Karolina Staros. The conversation afraid the brilliance and shadow of the prosecutor's profession, who we are, what we are allowed to do in public life and where the limit of our activity is.

The following day, a gathering was held with Dr. Hanna Machinska, Deputy Ombudsman, moderated by prosecutors Aleksandra Antoniak-Drożdż and Alfred Staszak.

The Ombudsman spoke about her experiences with intervention on the Polish-Belarusian border, about providing assistance to refugees, about the difference in the approach of Polish authorities to refugees on the Ukrainian and Belarusian border, about the attitude of Border defender officers and about illegal push-back practices.

On the last day of the festival in our shelter we hosted young activists of the Border Group. Marysia Poszytek, Michał Dawidziuk and Bartosz Cybulski shared their cognition and experience of events taking place on the Polish-Belarusian border. They are amazing young people who fight for human rights all day, helping refugees straight at the border.

Our workshop shelter besides became a mini gallery of photography by Mikołaj Kiembłowski and Agata Kubis. The work presents shocking situations from border forests, and their protagonists are refugees, especially children.

In addition, prosecutor Karolina Staros moderated a discussion on animal rights involving activists from the Viva Foundation and Open Cages.

In the afternoon, a workshop was held in the ASP workshop shelter “Limits of powers of law enforcement“ conducted by attorneys Marta Tomkiewicz-Januszewska and Paweł Murawski and prosecutors Joanna Garus and Piotr Wójtowicz. Lawyers talked about the rules on the legitimacy and retention of a citizen by an officer, the powers and duties of a individual who is legitimized and detained. The detention protocol has been discussed as the most crucial paper to reflect the course of the full operation and the content of which is influenced by the individual detained who may require his statements to be placed there. The question was raised as to what activities the detainee must undergo, and lawyers recalled the powers of police in a situation where the detainee does not want to undergo, for example, a sobriety test. Piotr Wójtowicz, the prosecutor, talked about the hearing, its conduct, the conduct of the hearing.
