During Prof. Marcin Matczak's visit to the studio on The Question subject there were many. Paweł Orlikowski, the host of "Evening on the Theme", could not overlook the subject of fresh events in Polish politics. Our guest mentioned, among another things, what the regulation of law is. Which, by the way, may come in useful for some.
– The regulation of law is the regulation of law, not the people and their whim. If individual destroys the regulation of law, it destroys the basic social fabric of allowing a man to live as he wants to live. Breaking the constitution always ends with breaking a man," he noted.
Prof. Matczak straight about Dud and Nawrock: "Constitutional criminals"
Paweł Orlikowski from the Temat asked straight whether the highest state officials, Andrzej Duda and Karol Nawrocki, were constitutional criminals. Prof. Marcin Matczak's answer was immediate.
- Yes, I have said so many times. I mean about Andrzej Duda many times, due to the fact that his constitutional offence, starting with the non- swearing-in of legally elected judges, with this night's swearing-in of doubles and later a full lot of attacks on courts, even through the laws he prepared concerning the ultimate Court, [it] was manifestly unconstitutional," commented the lawyer.
As to the current acting head of the state Karol Nawrocki, the guest of "Evening on the Theme" emphasized that at first "it was not known". But, as prof. Matczak pointed out, after a fewer months of this presidency, the substance became clear.
– 1 could hope that he might build in himself respect for the Constitution, that is, at the will of the nation, but he did not. First of all, erstwhile he refused to appoint the judges of the general courts in bulk, taking into account again the issue of the balance of authorities – this was besides an act which, in my opinion, violates the constitution. But what he's doing now is just a typical constitutional sabotage – he hit a lawyer.
Nawrocki "Constitutional saboteur". The lawyer lists examples
– This is simply a situation where he has a clear legal standard, due to the fact that we have a 2015 Constitutional Court ruling, which in the operative part says that the president must immediately take his oath from the Constitutional Court judges. This conviction under the Constitution is universally binding, and president Nawrocki breaks it. So it is simply a constitutional crime, but for me, in a sense, it is worse that it is contempt for the nation," noted Prof. Marcin Matczak.
Our guest pointed out that this should be assessed in these categories, especially due to the fact that we are dealing with a individual who claims that he wants to service the nation and wants the good of Poles. According to the guy on the theme, there's 1 main problem.
– This good he defines himself as his own good and his party, and it in the Constitution is defined as the common good of all citizens," he pointed out.
You will besides remember how Andrzej Duda kicked Charles Nawrocki. It was, of course, the vows of the judges of the TK. Prof. Matczak, however, estimated that the erstwhile president and interviewer Krzysztof Szczucki "become the caricature of lawyers". Why? perceive to our guest's opinion on Evening at Theme.
In 1 Tusk agrees with prof. Matczak. Nawrocki is likewise spoken of
It is besides worth quoting here the words of Prime Minister Donald Tusk. The alternatively harsh relation between the president of the Council of Ministers and the Chancellery of the president is not essential to remind anyone. Cooperation is difficult, and Tusk late (not for the first time) bitterly spoke about Karol Nawrocki. During a press briefing in Tokyo, the Prime Minister said:
– We have precisely specified a political situation, where we have a blocking specified a political saboteur as the president with his veto, we have his full team, his full law firm, all advisors who do nothing else by morning, they only harm Poland and the Polish government, and in this peculiar issue not only in my opinion, I think we all feel it, this non-voting is simply a manifest violation of the President's duties.
