Another proceeding took place in the Toruń territory Court on Thursday regarding a pensioner accused of public provocation to commit crimes and criminal threats against Jerzy Owsiak. The reason for the accusation was a comment on Facebook about financial ambiguities related to the activities of the president of WŚP.
Jerzy Owsiak was interviewed remotely during the trial. Previously, the typical of the president of WIŚP requested that it be limited only to the notification made by the proxy. However, the court pointed out that, in view of the gravity of the alleged crime, a proceeding was necessary.
Oatsiak stated that an apology from a 66-year-old would be adequate to complete the case. The accused in consequence apologized to him, but at the same time demanded that the victim besides apologize for the WOŚP run to fight sepsis. As many voters most likely remember, the large-format posters utilized in this initiative during the electoral run before the 2023 parliamentary elections had a alternatively aggressive political subtext for many: “Poles! Let us overcome this evil!!! We win with sepsis". “The sepsis was grey on a dark grey background, while the remainder were bright, yellow-orange, and the last ‘MY’ in white-red colors”.

They were the ones who gave the victim the pensioner's entries, which, in their opinion, were expected to pose threats. However, the context of all comments shows that the phrase "death of a man" utilized by a female in 1 of the entries is simply a call for Jerzy Owsiak to retreat from public activity. The comments of the 66-year-old women afraid financial ambiguities surrounding the activity of the large Orchestra of Christmas Charity and expressed an appeal to settle invoices related to it.
The case begins on 13 January this year. At that time, a female posted that post on Facebook. 2 days later, at 6:25 p.m., she was detained at her home by officers of the Municipal Police Command in Toruń. She was then transferred to the police station where she was interviewed and heard allegations of public provocation to commit crimes and to direct criminal threats against Jerzy Owsiak.
Prosecutor of the Toruń Centre-West territory Attorney's Office applied preventive measures to a 66-year-old: a property guarantee, a ban on leaving the country, an work to go to the police station 3 times a week, a ban on contacting and approaching Jerzy Owsiak for little than 100 metres, and a ban on public commenting. The police besides secured her phone.
The lawyers of the Ordo Iuris Institute provided suspicious legal support. As they stress, the woman's entry did not go well beyond the standards of speech found on social media, where there is frequently a phenomenon of vulgarisation of the language, resulting, among others, from the anonymity of users. In the opinion of the Institute, the comment was emotional and was an expression of the author's convictions active in the ideological dispute, so it cannot be considered a crime.
Ordo Iuris besides pointed out that there were no grounds for detaining a female – her individual data was known, her entry was secured, and there was no fear of escaping or having to proceed in accelerated mode. According to the lawyers, detention was so an excessive and disproportionate measure.
The Institute has submitted a complaint to the detention decision and to the preventive measures taken. On 27 March, a gathering was held before the Toruń territory Court concerning this case. The court accepted the arguments of the defenders and waived the preventive measurement in the form of police supervision. The trial started on 18 June.
