President defends PiS politicians
“I told them that if they were placed in a prison, they would be the first political prisoners in Poland after 1989. I do not agree with the verdict of the court; I believe it is simply a violation of constitutional standards, an effort to break the presidential prerogative. The act of grace is in force," stated the president in an interview with Radio Zet.
Punishment for Kamiński and Wąsik
The territory Court in Warsaw sentenced Mariusz Kamiński and Maciej Wąsik to 2 years imprisonment. In addition, they have a five-year ban on administrative posts. erstwhile heads of the Central Anti-corruption Bureau were found guilty in connection with the alleged land scandal.
Why does the law of grace not work in this situation?
Until now, the individual pardoned by the president has not been convicted again. Let us remind that on 30 March 2016 – following requests of defence and prosecution against the act of favour of the president – the territory Court in Warsaw dismissed the proceedings against Kamiński and the others sentenced in the ground affair. However, after six months – 30 September 2016 – 2 applications for the erasure of this redemption were received by the ultimate Court; 1 of the parties to the Andrzej Lepper family. On May 31, 2017, before the issue of cassation was resolved, the seven-member composition of the ultimate Court stated that the presidential right of grace could be applied only to the final convictions, while the President's decision in the Kamiński case was not in constitutional norms.
