Amendments made by resolution
The authors make it clear:
We believe that the full procedure can be made by a resolution of the Sejm, without the request to change the Constitution. This is, of course, a very courageous thesis, but it is based on the fundamental law itself.
The 2 lawyers believe that the “Przebańska” and “political justice” should be put to an end in favour of the Law and Justice Union. Let us callback that the current president of the Constitutional Court has been described by Jarosław Kaczyński as a "social discovery". The president of the Law and Justice organization was present on TVP's breakfast program and clearly forgot himself. And that statement, why it is hard to be surprised, is inactive mentioned to him today. After all, in Poland there is formally a tripartition of power. Unfortunately, now the Constitutional Court, in which erstwhile PiS politicians: Stanisław Piotrowicz and Krystyna Pawłowicz sits, performs the interests of the right.
Once, as a consequence of miscalculations of the party's management from Nowogrodzka Street, the TK did the bear group a favor. It is about ending the abortion compromise and tightening the right to abort pregnancy, which has outraged and mobilised especially young people and naturally women to show a red card at the ballot box.
Constitutional Reset
As for the changes in the TK, it will not be possible to introduce them by means of laws, due to the fact that this would affect the veto of Andrzej Duda. The President, who besides approved the alleged "dublers" according to his critics, sees nothing incorrect with the actions of this crucial body in the judicial strategy in our country. However, he accepted 1 of the leaders of the Confederation of Krzysztof Bosak at the Presidential Palace.
Bosak, accompanied by organization colleague Stanislaw Tyszka, stated at a press conference after the gathering that in his interview with the president the key issue was the amendments to the Constitution, which “end chaos in the state, common negation of compositions of chief constitutional bodies specified as the Constitutional Court, ultimate Court, National Judicial Council‘.
He added that the Confederate advocated the creation of a "legal forum" that would elaborate in item the ideas presented by the Confederate and another parties.
– We measure the gathering as good, constructive. The president has shown openness to our proposals. (...) He announced that if we win in establishing specified a working group, he would besides delegate to specified a forum his representative said Deputy Marshal of the Sejm.
Kaczyński is against
Andrzej Duda, despite being a TK defender, was ready to talk to Confederate representatives who have an interesting idea. However, Jarosław Kaczyński is hardened. He believes that the way to changing the constitution is long and complicated. – There is no specified anticipation in this term – he reacted to a possible reset.
If the constitutional reset were to enter into force, it could affect the decline of polarization and increase the credibility of the full justice strategy in Poland. He would show that the compromise in Polish politics is real, unfortunately it seems that we are talking about utopia.
