The full material was secured by the territory Attorneys of the Crime Investigation Commission against the Polish Nation in Warsaw for the ongoing investigation. The burial of the victims' temporal remains is possible in connection with the completion of their research.

An investigation into a case referred to as the Katyń Crimes – i.e. a case constituting a war crime and a crime against humanity, killings of no little than 21,768 Polish citizens carried out in the period from 5 March to an unestablished day and the period 1940 in the USSR by officials of that State, acting in the execution of the resolutions of the Political Committee of the All-Union Committee of the Communist organization (bolsheviks) in Moscow on 5 March 1940 – has been conducted by the Branch Crime Investigation Commission against the Polish Nation in Warsaw since 30 November 2004. It was initiated as a consequence of formal reports of a crime filed by associations bringing together relatives of victims of the Katyn massacre. The notorious cognition of Stalin's death and another high-ranking organization and state officials of the USSR liable for execution did not prevent the initiation of the Katyn investigation due to the fact that the circumstantial provisions of the Act on the Institute of National Memory in Article 45(4) order criminal proceedings even erstwhile it is known that the perpetrators of the crime are no longer alive. This regulation was introduced by the legislature in view of, among another things, the work to make amends to all victims of totalitarianism.
