90 million PLN to be returned. These foundations must return the money from the FS

None of the entities called for reimbursement of grants from the Justice Fund returned money - the Ministry of Justice informed. According to the Ministry, the amount of unduly collected grants totals PLN 90 million. MS has not yet issued administrative decisions on this issue.


In late March, MS chief, lawyer General Adam Bodnar called 8 entities, including. Profeto Foundation and Fidei Defensor Association, to return the money from the Justice Fund. At the time, the hotel stressed that the erstwhile authorities of the ministry led by Zbigniew Ziobro granted money to these entities, even though they "did not meet the required criteria or were intended to be earmarked for purposes different from those to be financed by the Fund".

"None of the entities called to return the grant returned the money" - informed PAP of the Ministry of Justice, adding that it had not yet issued administrative decisions on the reimbursement of the aid received.

The Ministry besides reported that the procedure provides that if the contractor fails to reimburse the funds as requested, a decision to reimburse the funds will be taken within the administrative procedure. "The administrative decision shall specify the amount and the time limit for the reimbursement of appropriations. The contractor has the right to appeal her. Where the decision is maintained in force and the recovery of the appropriations is inactive not possible The next step is to conduct enforcement proceedings to recover funds" - said the ministry.

Who has to give the money back?

Calls from the head of MS were addressed to:

  • Profeto Foundation – return 66 million 87 1000 PLN 467,

  • Foundation Strong in Spirit – 9 million PLN,

  • Fidei Defensor Association – 3 million 802 1000 PLN 665,

  • Foundation of the Center for Harmful Assistance and Crime Prevention - PLN 3 million 435 thousand,

  • Foundation Institute of Lawfulness – 2 million 761 1000 PLN 701,

  • Foundation of St. Benedict – 2 million 138 1000 PLN,

  • RTCK Foundation – Do What You Love – 1 million 464 1000 PLN,

  • Foundation Institute of Sovereignty and Heritage in Europe – PLN 638,000.

The entities called for reimbursement were to return it to the Justice Fund's account within 15 days of receipt of the call for payment.

"The amount to be recovered has been determined on the basis of a detailed analysis of the documentation, reports, bank statements, as well as grant settlement protocols. The audit was utilized to verify whether and to what degree the budget of the Justice Fund in erstwhile years was implemented in breach of procedures" - said MS.

According to the Ministry of Justice, in accordance with the Public Finance Act, control is simply a formal basis for seeking reimbursement of undue public funds and in the absence of legal recovery.

What is the Justice Fund?

The Fund for Harmful Aid and Postpenitentiary Assistance, referred to as the Justice Fund, is simply a special-purpose fund, i.e. its resources must be spent exclusively for the purposes of the Fund.

The FS was created in 1997 to aid victims and witnesses of crime, and those who were sentenced to prison and return to a fair life in society (this is postpenitentiary aid).

As of 2017, the fund has received an additional nonsubjective to counter crime. His activities in years erstwhile the United Right ruled Poland are presently under investigation by the National Prosecutor's Office, as well as corrective actions by the Ministry of Justice.
