First president of the ultimate Court Margaret Manowska accuses the Minister of Justice of actions undermining assurance in judges. A dispute over the position of a part of a court warehouse is not an academic argument, due to the fact that it concerns the validity of judgments and the sense of legal safety of citizens.
A conflict of institutions strikes a citizen
Małgorzata Manowska, the first president of the ultimate Court, is firmly responding to the actions and statements of the Ministry of Justice concerning judges appointed after 2018. In her public statements, she indicated that insinuation campaigns and the individual discredit of judges would be confronted with the reaction of the ultimate Court.
The Ministry presents its own proposals as an effort to kind out the consequences of the dispute over the National Judicial Council and the enforcement of European Courts' judgments. Critics of these plans respond that the collective questioning of the position of judges violates the prerogative of the president and could origin chaos in millions of cases.
Rule of law cannot be a organization slogan
Poles have the right to know whether the conviction on them will stay valid. This concerns divorces, inheritances, loans, criminal trials and business disputes. A state that maintains 2 competitive legal orders over the years shifts the cost of political conflict to a average citizen.
The solution must respect the Constitution, the case law and the rule of the inadequacy of judges. Trust cannot be restored by publically branding full professional groups. Nor can it be rebuilt by pretending that there is no problem. We request a bill prepared not to make another wave of contested judgments.
The state needs a single legal order
Executive power has the right to propose reforms. The ultimate Court has a work to defend the independency of judgment. However, both parties are liable to Poles for the stableness of the state. Sovereignty does not consist in replacing the law with the will of 1 organization or in giving the solution to all Polish case to external institutions. It relies on the ability of the Republic to repair its institutions in accordance with the Constitution.
