Ordoiuris: The era of sex censorship in Poland begins

It's done. The Government Legislative Center published the authoritative draft of the Censorial Act. 3 years in prison are to be threatened by fact incompatible with sex ideologists and LGBT activists. We've been preparing for this day for months. Now we gotta stand up to the challenge to prevent the statutory gagging of social organizations, priests, journalists, politicians and... all average people who preach average views.
Three years in prison for the truth? We know the draft act on “Speak of Hate”.
On Wednesday, March 27 – erstwhile most Poles were busy preparing for the large Night – a draft amendment of the Criminal Code was announced on the website of the Government Legislative Centre, which imposed a punishment of 3 years imprisonment for “calling hate” due to “sexual orientation or sex identity”. The same punishment may be granted to a individual who ‘insults a population group or a individual due to his (...) sexual orientation or sex identity’.
In the light of the bill of the Minister of Justice Adam Bodnar, we can go to prison even for stating as apparent facts as:
- "There are 2 sexes."
"Flat is simply a biological fact, not a question of choice."
"The sex is recorded in genes and cannot be changed."
"Transsexuality is simply a sex identity disorder."
- “Crossing the breasts and genitals of teenagers is unreturned mutilation of their bodies.”
"Gay acts are sinful."
"Men identified as women should not compete in women's sports competitions."
These statements may shortly be regarded as incitement to hatred or insulting of declared homosexuals or all identifying themselves as "transgender" "unincorporated" persons, etc. The grim suggestions of widespread censorship panic can already be heard from the mouth of members of the government coalition.
– Anyone who says, like president Duda, that LGBT is not people, but ideology, will gotta answer. Ms Żukowska called late from the parliament's mouthpiece, and Minister of Education Barbara Nowack said that “hate” with which the government will fight is spread among others from church ambon.
We will fight for freedom of speech to the last breath. Therefore, even though the public consultation of this task started the day before the beginning of the Paschal Triduum, our lawyers prepared a critical legal analysis of the project, which we submitted in consultation, at an express pace.
Of course, we are afraid that the government will, despite this, adopt a task that will most likely be in the Sejm later this month. Then we will launch a broad run of force on Members and Senators. Next, it will be time to build social force to dare president Andrzej Duda to veto the bill.
Our friends at the Center for Life and household have already launched an appropriate online petition "Stop the dictatorship of minorities". Together we scope almost a million Poles, so I believe that the president will hear our voice.
Our success gives hope... In fresh years, lawyers of Ordo Iuris have repeatedly proved their effectiveness in defending freedom of speech.
It is adequate to mention, for example, more than 130 favorable judgments of courts (including ultimate Court judgments), in which courts confirmed that life defenders have the right to show on the streets of Polish cities what abortion is, or the case of Mr Janusz Komenda of IKEI, who was released from work for his opposition – based on their own spiritual beliefs and quotations from the Scriptures – in the face of imposing on workers participation in promoting sex ideology.
But akin things keep coming back. At the end of last year, Mr. Adam, who was fired from work, asked for the aid of Ordo Iuris' lawyers for the fact that – in consequence to the invitation of employees to the Equality Parade – he culturally informed the management that the employer was not a political organization and that the employee's views should be their individual, private issue. He did so after years of ignoring the pushy propaganda of the LGBT movement in the company. The termination of the employment contract stated explicitly that Mr Adam's message on the LGBT movement "could have had a negative impact on LGBTQ's well-being", and his "worldview lies in full contradiction with the values of the Company in conducting business, and besides adversely affect the atmosphere at work". He went to the Warsaw Labour Court prepared by our lawyers in which we request that Mr Adam be reinstated.
In March, however, good news came to us about the dismissal of disciplinary proceedings against a teacher from Toruń who criticized online Halloween celebrations at school. In her commentary, the female wrote that the “fun” involving gruesomely characterized students and teachers was, in her opinion, “the promotion of ugliness and rot.” The entry did not like 1 of the women discussing with her, who checked her interviewer's profession, and after stating that she was doing her teacher's profession, she made a notification to her about committing a disciplinary offence to the school board. The female to whom the investigation was initiated requested assistance from the Centre for Process Intervention of the Ordo Iuris Institute. Thanks to our aid – the proceedings were discontinued.
Many people experience censorship in portals specified as Facebook or YouTube. any judges besides try, on their own, to do the Sejm and to ban “the speech of hatred” themselves. This is what happened late on the run "Stop Peedophilia".
The run was organized in consequence to the increasingly aggressive lobbying of LGBT activists, who consistently call for the implementation of “sexual education” in Polish schools in accordance with the standards of the planet wellness Organization. citing the WHO, LGBT activists are trying to make the impression that their imagination of sexual education is material, substantive and appropriate to our children. At the same time LGBT lobbyists, citing WHO standards, respond allergicly to... quoting them.
Our friends from the Pro-Right Foundation conducted a run in which they spread cognition of the pathology of sexual education advocated by sex activists and left-wing politicians. The run aroused rage in LGBT lobbyists.
Gdańsk courts imposed a punishment of 15 1000 PLN for conducting the campaign. In March a akin conviction was passed in Szczecin, where a volunteer of the Pro-Right Foundation was sentenced to life. Both decisions are de facto the implementation of the concept of "talk of hatred", which (for now...) inactive does not be in the Polish legal system.
Since in specified cases we do not have the right to proceed to the ultimate Court – we will request the Ombudsman to file an annulment.
For now, however, we are talking about these 2 judgments as scandalous, censorical exceptions. The adoption of a government task will make this exception a regulation and the punishment for the fact will be borne for far little "controversial" statements.
We besides have a large fight for freedom of conscience. Donald Tusk late announced that he intends to... punish doctors who refuse to execute abortion due to his beliefs! The Prime Minister's announcements have already translated into concrete projects. The Minister of wellness submitted a draft regulation for public consultation on the basis of which any wellness institution implementing an agreement with the NFZ to supply hospitalisation services in the field of gynaecology and midwifery would be obliged to execute abortions.
Meanwhile, “freedom of conscience” is 1 of the most crucial human rights recorded straight in the Polish Constitution.
Our experts have already prepared a number of comments and legal opinions, in which we prove the complete illegality of Donald Tusk's announcements. His plans hit the universal European guarantees of civilian rights. wellness professionals who will be persecuted by the authorities for exercising constitutionally guaranteed freedom of conscience will be able to number on our help. No 1 can be forced to kill unborn children. No 1 can be forced to castrate teenagers as part of “sex change”. Finally, no 1 can be forced to euthanize sick, aged or simply... depressed. This is what the fight is about erstwhile we talk about freedom of conscience.
We request to be ready for quite a few work. We must scope politicians, journalists and all those Poles for whom freedom of speech is of large importance with our analyses. We do not want to return to a time erstwhile the fact is told only in the privacy of our home, avoiding the ears of children who may unconsciously betray the “talk of hatred” of parents in kindergarten or school.
We are joining the committee's parliamentary work, holding training meetings for journalists and social activists. We will produce infographics and conduct a run on the threat of censorship on social media. At the same time, we have already donated a popular scholarly book on "the speech of hatred", in which 1 can besides read about the fact that this censor thought was first proposed by the UN... russian delegates.
We will make all effort to usage all legal opportunities to halt government censorship. If we stay passive now – we will lose freedom of speech for years and each of us will be able to go to jail or pay immense penalties for telling the truth.
