According to Radio Zet, the Ombudsman demands the abolition of provisions that let the alleged pushbacks on the border with Belarus. It's about going beyond the line of those who managed to cross it. Marcin Wiączek believes that the regulation prepared by the Law and Justice Office is not constitutional.

The Ombudsman has already asked the fresh head of the Ministry of civilian Rights Marcin Kierwiński to solve the "most crucial problem" of the alleged pushbacks utilized by the Border Guard, i.e. the return of foreigners to the state border line just after the detention.

Wiączek expects legislative changes

I hope you'll come forward to my presentation.demands and will lead to legislative changes enabling migrants to implement their basicrights“ – wrote RPO Marcin Wiązek in a letter to the head of the Ministry of abroad Affairs.

In his letter, the Ombudsman noted that in fresh years the number of foreigners arriving in Poland has increased significantly..The Belarusian regime's exile crisis on the east border, followed by the outbreak of the war in Ukraine, forced the Polish authorities to take urgent measures aimed, on the 1 hand, at protecting the state border and maintaining control of entry and residence policies, and on the another hand, at safeguarding the fundamental rights and freedoms of arrivals.“ – said Marcin Wiątek.

Ukrainian refugees are treated differently

Marcin Wiątek believes that although Ukrainians arriving in Poland due to the war, the authorities of our country have behaved properly, in the case of a crisis on the Polish-Belarusian border, there may be reservations.

While in the case of war refugees from Ukraine, both Polish society and public authorities have made efforts to guarantee that those seeking protection in Poland find it, and that foreigners crossing Poland's border with Belarus – by the vast majority not regulated – the legal instruments adopted have importantly impeded or prevented them from exercising their fundamental rightsIt’s okay. ”

Wiączek points out that in the procedure of returning foreigners to the state border line, they resign from making an individual assessment of their actual and legal situation. That's what the problem is.
