Land gardens, which are an integral part of the life of many Poles, face a serious threat. In view of the planned changes to the zoning legislation, there is simply a hazard that many of these valuable spaces will be eliminated. The decision is in the hands of municipalities and the time for owners and owners of plots is very limited.
Changes in regulations – what changes?
In 2025, all municipalities in Poland will be divided into 13 planning zones, which will importantly affect the way space is planned. The game gardens will be allowed to stay in only 2 areas: a single-family housing area and a green and recreation area. another zones can be utilized for commercial purposes, including the construction of fresh settlements or another improvement investments. This means that many plots of land can be utilized for liquidation.
The Polish Association of Departmentists (PZD) expresses serious concerns about these plans. Bartłomiej Piech from PZD points out that there is simply a real hazard that the game gardens will go to the remaining 10 planning zones, where they will lose their chance to stay in the local planning plan. In practice, this would mean that game gardens can be liquidated without further use.
Public consultation – a chance to save
Despite worrying announcements, the planned changes are not yet final. As provided by the Ministry of improvement and Technology, each spatial planning plan will be subject to public consultation. This means that the voice of the parcels and the needs associated with the existence of parcels should be taken into account in the decision-making process.
The municipalities that decide to liquidate the Rod will be required to conduct a public consultation. The plotters will have a chance to express their views and put forward arguments in favour of leaving the plots. However, this does not mean that the time for action is unlimited. The procedure provides for a short time to submit applications – only 21 days after the municipality has announced its plans.
How can gunmen save their gardens?
If the zoning plan provides for the liquidation of game gardens, plotters can apply for the preservation of the ROD in the current state. In order to effectively safeguard their interests, an appropriate application should be submitted to the municipal office within 21 days.
A model application can be found on the website of the Polish Association of Landowners. The key component will be to supply the geodesic game number, which can be checked in the State registry of Lands and Buildings or at geoportal.gov.pl website. Accurate and timely submission of the application is crucial for the future of game gardens.
Other options and actions
In the meantime, plotters should keep track of the improvement of spatial planning in their municipality. Participation in the public consultation and mobilisation of the local community can influence the final decision of the municipal authorities. It is besides worth considering organising meetings with another plotters and local leaders in order to jointly make defence strategies against planned liquidation.
Future of game gardens
Final decisions on the future of game gardens will depend on the activities of municipalities and the activity of plotters themselves. Although the threat of decommissioning is real, there is inactive a chance to save these precious spaces. fast action, effective usage of available legal resources and mobilisation of the local community are crucial. If the plotters are able to actively engage in the consultation process and submit proposals in due time, they have a chance to defend their gardens and preserve them for future generations.
