The Warsaw territory Court postponed the examination of the prosecution's application for temporary detention for erstwhile Justice Minister Zbigniew Ziobry until 5 February. As Mr PiS's defenders informed, the reason for their request to exclude the justice who led the case.
This further postponement — earlier in December, the gathering was postponed due to formal shortcomings in the prosecutor’s documentation. This time, the defence challenged the impartiality of the judge, indicating, among another things, her membership of the Iustitia Association and the publically presented views that, according to lawyers, may have an impact on the assessment of the case.
Prosecutor Piotr Wozniak, supervising the investigation into the Justice Fund, considered the court's decision to be formally valid, although opposed to the defence motion.
