During the first 2 months of the tightening of border controls by Home Minister Alexander Dobrindt (CSU) received respective lawsuits on behalf of asylum seekers. In May, 3 Somalis, with the aid of Pro Asyl, successfully sued the ministry before the Berlin Administrative Court against their rejection at the German border. A spokesperson for the Ministry of the Interior acknowledged in consequence to the magazine "Stern": "There are now 3 further legal proceedings active in rejecting asylum seekers".
In its first ruling, the Administrative Court in Berlin criticised, among others, the insufficient justification for rejections. Dobrindt later promised to correct it, but the ministry intends to present it only in court," said press secretary “Stern”.
Alexander Throm, spokesperson for interior policy of CDU/CSU club in Bundestag, told the magazine, "In our constitutional state it is apparent that you can appeal to court." This could be expected in the event of rejections. "However, this is simply a fundamental issue of European law which can only be explained by the European Court of Justice," said Throm.
A pro-immigrant EC organization to bargain Germany
The manager of Pro Asyl (who supported migrants in the German court proceedings against the German government) Karl Kopp, in turn, said on Friday the Berlin paper "Tagesspiegel" that whether the Somali case goes to the European Court of Justice depends solely on those concerned. At the same time, however, Pro Asyl called on the European Commission to initiate infringement proceedings against Germany.
Konstantin von Notz, deputy leader of the Green organization club, criticized the Interior Ministry in "Stern" magazine: "To this day, the leading ministry cannot answer the key questions". His legal position is absurd," said von Notz.
"We one more time powerfully urge Minister Dobrindt to refrain from rejecting applications and presenting the long-awaited justifications for these measures," he added. Greens – a organization most conducive to migrants – criticized them before introducing fresh restrictions at borders.
Somali case and policy tightening
