The Attorney-General sent a motion to the Sejm to waive immunity to Mr Mariusz Błaszczak, informed the National Prosecutor on Wednesday. The case concerns an excess of powers and a failure to fulfil duties at a time erstwhile he was head of the MON. It is about declassified and making available the plan of Polish Armed Forces.
The territory Attorney's Office in Warsaw, Department for Military Affairs, conducts investigations into the excess of powers and failure to fulfil duties in soldiers and staff of the Ministry of National Defence in the case Abolition of the top secret and secret classification from fragments document of operational planning of the Polish army.
‘The assessment of the evidence provided grounds for accepting a sufficiently substantiated suspicion that Mariusz Błaszczak as a public officer, i.e. the Minister of National Defence, acting at short intervals, in the execution of a pre-conceived intention, being obliged and liable under the Act on the Protection of Confidential Information for the Protection of Classified Information at the Ministry of National Defence, He's out of his league.“The prosecutor’s office has been informed.
Request to waive the immunity of Błaszczak. ‘It has caused highly serious damage’
According to the prosecutor's office, on 31 July 2023 Błaszczak abolished the strict secret and secret clauses from the strategical operational planning documents, even though the statutory grounds for the protection of classified information contained therein have not ceased.
Subsequently, on 17 September 2023, he publically disclosed and contrary to the provisions of the Act on the Protection of Classified Information utilized fragments declassified by him on the authoritative Law and Justice organization profile on platform X.
The passages made available included, among others, the duration of conducting a stand-alone defence operation, the determination of strategical rungs and defenceheads of the Republic of Poland and the date of arrival of the Alliance Force.
‘And he committed this act to achieving individual benefits for its political formation – i.e. organization and election committee of the Law and Justice – the prosecution declared.
As assessed, it thereby affects the public interest and has caused ‘exceptionally serious injury for the Republic of Poland its independence, sovereignty, territorial integrity, global position and cohesion of the North Atlantic Alliance".
