It can be suspected that the decision of the PCW was not substantive but political. Receipt of the full subsidy for current activities is like the party's delegation. A organization for which nearly 8 million voters voted last year, a organization which is presently the largest opposition force in the country. The fact that the PKW decision was political confirms the result of the vote. The PiSu study was rejected by 5 votes to 4. The vote against was the 5 PKW members nominated by the current Sejm, and against were the 4 nominees for the regulation of the United Right. But is it that the study was indeed flawed and had to be rejected, and that the 4 members of the PCW "from giving PiS" for purely political reasons did not support the proposal to reject the report? However, it may besides be reasonable to say that the study was correct and should have been accepted, but the 5 members of the PCW "as of the 13th December coalition" did not support the proposal for adoption for purely political reasons.
So how was it really? Who's gonna settle this? From a legal point of view, the situation is simple. A organization shall be entitled to an appeal to the Chamber of Control of the Extraordinary ultimate Court from the decision of the PKW, and shall support that decision. It would seem that there is nothing left but to wait for a substantive ultimate Court ruling. Nothing more wrong. Ryszard Kalisz, a associate of the PKW from the group of the 5 people who rejected the PiSu study stated that “If there are judges or persons appointed as judges of the ultimate Court after 2017, then for us these are resolutions or non-existent rulings.”. Who is Richard Kalisz? Regardless of the current functions, he is primarily a citizen of the Polish state. A in accordance with Article 32, point 1 of the Constitution ‘All are equal to the law". Since we are equal with Mr Kalisz before the law, I declare on behalf of a multitude of voters voting for the United Right that if there were members or persons appointed as members of the PKW after 2023 in the composition of the PKW that rejected the PiSu report, then these are non-existent decisions for us.
The voters of the United Right so have the right to anticipate the PiS organization to be paid a subsidy. If this did not happen, in my opinion, each of the voters will have the right to deduct from the amount paid to the taxation Administration any part and to deposit it straight into the PiSu account. I'm already proceeding voices that it's civilian disobedience, that it leads to anarchy. Absolutely not. This is simply a redirection by citizens of the due batches of taxation money straight to the PiSu account, but for the defaulting public administration duties. Therefore, a copy of any proof of payment of money to the PiSu account must be sent to the gross Office as a documented confirmation of the merits and the amount of the deduction. The PIS should monitor these payments on an ongoing basis so that they do not exceed the amount of the subsidy due. If this amount is exceeded, all surplus payments must be reimbursed to taxable persons so that they can pay them to the taxation Office, thereby eliminating the excess deductions made.
I trust Mr. Richard Kalisz, a postgraduate Faculty of Law and AdministrationUniversity of WarsawHe knows and respects the Constitution. I so trust that it will respect the voter's redirection of funds from the taxes due straight to the subsidy. After all, as a sovereign, we are equal before the law. All without exception, Mr. Kalisz, me and all reader of this column.
