Prok. Anna Adamiak, the press secretary of the lawyer General, announced on Friday that it is possible to bring Antonio Macerewicz to criminal work after obtaining the consent of the Polish Sejm.
Macerevich could lose his immunity.
"The basis for the motion to waive immunity to Antoni Macerewicz is the findings made on the basis of the evidence collected in the investigation of the National Prosecutor's Office's Investigation Group No. 4 established by the order of lawyer General Adam Bodnar No. 48/2024 of 8 November 2024," says the press release.
The National Prosecutor's Office established Investigative squad No. 4 after the Ministry of National Defence submitted a comprehensive study on the activities of the alleged Smolensk Subcommittee. Along with the document, the ministry sent as many as 41 notifications of possible crimes – this is the consequence of detected irregularities in the functioning of the committee.
After analysis of the materials by investigators from the squad appointed in the National Prosecutor's Office, it was considered that there was a reasonable suspicion of a violation of the law. Consequently, 5 separate proceedings were opened on November 18, 2024, which included a full of 21 acts.
These crimes were to consist of:
disclosure to unauthorised persons of classified information and another protected information,
incorrect processing, production and retention of classified information materials,
the breach of powers and the failure of public officials, including the Minister of National Defence and the Chair of the Subcommittee,
forgery of papers and a certificate of untruth in documents,
failure to carry out supervision and control of the regularity of the usage of funds and public spending in connection with the functioning of the Subcommittee,
failure to fulfil the duties and obstruction of criminal proceedings conducted in the National Public Prosecutor's Office under PK III 1.Ds.1.2016,
failure by the Minister of National Defence by failing to take action to prevent the demolition of Tu-154M No 102 aircraft and by facilitating the demolition of the designated aircraft by members of the Subcommittee.
"In view of the protection of associate Antoni Macierewicz, parliamentary immunity, the consent of the Polish Sejm to a criminal charge for an act prosecuted from the public prosecution determines the anticipation of charging him with the offence described in the motion and carrying out another procedural acts involving him" - emphasised the investigator.
