– There is simply a debate in the Sejm on government regulations. With the provisions that they intended and at least in the public opinion, strengthen the right of soldiers to usage weapons at the border to defend this border, as well as to defend wellness and life themselves. However, even before the debate on these provisions began, these provisions were castrated through the government's auto-amendment. At the moment, it could be said that, after the debate yesterday, it is hard not to get the impression that we are delving into legal doubts about the rules that were meant to simplify! It's a curiosity situation.
The rules are moved, erstwhile in the penal code, erstwhile in the Act on the usage of Arms and Direct Force. Chaos and the number of doubts increase exponentially with the government's intention to amend the rules. As a Confederate, we powerfully argue this trend.
The rules that regulate the usage of weapons by soldiers and officers at borders to defend it should be laconic, simple and clear. In circumstantial situations, the facts as to the scope of the usage of weapons should not depend on the legal explanation of the rules. Soldiers are not lawyers who are to pass legal opinions, holding a penal code in 1 hand, in the other, and a 3rd rifle, only should depend on the command of the commanders! The rules should be broad, give broad powers, and the commanders' orders should limit the usage of weapons. In accordance with the adopted State safety Policy, the strategy of the circumstantial services, the strategy for the implementation of the full operation at the border and the sense of the circumstantial commanders liable for circumstantial episodes. That's what it looks like in a average country. And in our country it will look like it takes respective twelve pages to print the proposed legislation! The Members who attended the debate yesterday cannot come to terms with what these provisions will propose.
In this situation The Confederation will table its amendment. Correction of very simple content. A laconic amendment. Namely Firearms can be utilized in cases where there is simply a request to defy a direct, unlawful attack on the integrity of the state border. This state border is expected to be a substance of defence here.
We can't make a situation where a soldier can usage a weapon only erstwhile an opponent crossing the border wants to take that weapon from him or wants to hurt him, or wants to kill him or wants to kidnap him! This minute of crossing the state border illegally must be the minute of activating the right to usage weapons and causing destructive effects to the sense of safety, comfort of wellness and yet the life of this attacker! Otherwise, we push officers and soldiers into legal uncertainty and their commanders, and the legal services of all uniformed services.
We are pushing into large doubt, which will only be settled by practice before the courts, after they are dealt with in concrete cases by prosecutors and then courts. We don't want this full way of wellness for soldiers and officers. Anyone who crosses the Polish border illegally should number for failure of comfort, wellness and in the finality of life. This was how it worked before the war, erstwhile Poland defended the Border defender Corps. This is how it is expected to work today, if we do not want the way of illegal immigration to work through Poland in 2 ways from Belarus to Germany and from Germany to Poland. We don't want that.
Poland is to be a safe country, to which it comes legally through the border crossing, through the airport, through appropriate border procedures, visa procedures, not pushing between barbed wires, between barrier rods and trying to slop our officers and soldiers. This is, again, unacceptable!
Soldiers and officers should be given a simple, clear, understandable right to usage means of direct coercion and to equip them with means and to give them the right to usage weapons if average means of direct coercion specified as a baton, gas, shield, handcuffs, smooth-bore weapons, taser, if these means do not work, the right to usage weapons should be given. And immediately, ladies and gentlemen, this full situation on the border will end, as he took his hand off, if 1 and the another sees that here you cannot go unpunished. In another case, what results from smuggling chats at the moment, namely that Poland and the border between Belarus and the European Union, i.e. the Polish-Belarusian border, become the safest route, with the least risk.
Word has spread around the planet that Polish soldiers and officers can shoot, but only in the air! Then you can approach them, even break their hand, skip them, leave them and go on and effort to be happy by getting into the courier's car and going to Germany. This has to halt now! That is why we are proposing a simple amendment, unlike the vague, complicated, gibberish amendments made by the ruling majority.
