Jola and Alicia heard at the office that they would not have a changed marital position like another couples, due to the fact that “Lublin is not Warsaw”, and according to the Constitutional Court, a regulation amending the models of matrimony acts is “unconstitutional”. another officials are trained to deny transcriptions to same-sex couples, others have long announced refusals. Couples must live in uncertainty and trust on the favour of officials. Meanwhile, the Ministry of abroad Affairs is silent and believes that the signature of the regulation ended the subject.
On 28 April 2026, the Provincial Administrative Court in Lublin issued a judgement nullifying the refusal to make a abroad transcript of the matrimony certificate of Jola and Alicia Sienkiewicz-Prochowicz. The Lublin civilian state office was obliged to make a Polish matrimony certificate for them and to enter it in the national register.
On July 31, Jola and Alicia received a Polish matrimony certificate. However, officials confirmed that they would not amend their PESEL records. In accordance with the civilian Records Act, information on the civilian position of a individual must be included there, and its amendment shall be recorded together with the transcription. In its statements to the media, the Authority stated that the judgement in Jola and Alicia only ordered the transfer of the document. However, it is clear from the reasoning of the judgement that their marital position must be changed.
The matrimony of Jola and Alicia was to be recognised by Poland to fix the legal gap that made them household in 16 countries of the European Union and in Poland strangers. The civilian position office in Lublin consciously enlarged this gap by issuing Jola and Alicia an authoritative Polish matrimony certificate, which despite the authoritative stamp does not even have the most basic effect of marriage, which is to change civilian status – says Maja ebony of the Love Association.
Offices are not apolitical
By refusing Jola and Alicia to change civilian status, the deputy manager of the usc mentioned the Constitutional Court's ruling of 28 July, but the office had already suggested that the change would not be made.

At least respective twelve offices have already benefited from the “Metrics” training. Only on 1 July, erstwhile the Central registry of Contracts was launched, there were 29 of them – a list of contracts with the Prof. Józef Litwin technological Institute Foundation, the publisher of “Metrics”, can be found in the register. Training has been organised regularly since February and since May their description includes a point on the justification of refusal decisions. Another training is scheduled for August 26. The cost of PLN 330 (or PLN 299 for subscribers to the “Metrics”) is covered by the offices' budgets.
The registry shows both offices from smaller towns and, for example, from Poznań – cities with an opinion supporting the local LGBT+ community. Ordo Iuris besides created his own guide to refusing. It contains references to an article by Dr. Kasprzyk, which, however, is no longer available on the website “Metrics”.
Officials have an inconsistent approach to transcription, in the authoritative environment paid training is offered with refusal of equal treatment and the individual moving it publically calls for the annulment of already transcribed matrimony acts of same-sex couples. On the contrary: The indifference of the hotel created a gap which was rapidly exploited by those motivated to make it as hard as possible to fight LGBT+ people with equal rights and inform the possible future power that they were guarding their common values. The cost of this political demonstration falls on families founded by LGBT+ people who have not been allowed to ask for equal treatment for 20 years.
